HomeMy WebLinkAbout1958-05-01; City Council; Resolution 3632 3 4 I 1 1 1 1 1 1 2 2 2 2 21 21 2( 2: 2t 2s 3c 31 32 RESOLUTION NO. 363 RESOLUTION OF THE% CITY COUNCIL OF THE CITY OF CARLSBAD GIVING NOTICE OF PROPOSED ANNEXATION , ,DESCRIBING THE BOUNDARIES OF THE TERRITORY TO BE ANNEXED, DESIGNATING SUCH TERRITORY AS "EAST CARLSBAD ANNEXATION #2. l", SETTING FORTH REASONS OF THE CITY OF CARLSBAD FOR DESIRING SUCH ANNEXATION; AND FIXING A TIME AND PLACE FOR HEARING 0 F OBJECTIONS FOR PROPOSED ANNEXATION. WHEREAS, the City of Carlsbad has heretofore received written reques from i? portion of the property o\yners in the area proposed to be annexed, requesting the annexation of the lands hereinafter described; and WHEREAS, the Mayor of the City of Carlsbad has instructed the admin- istrative officers of the City of Carlsbad to prepare annexation proceedings; and WHEREAS, on April 15, 1958, the boundaries of the proposed annexatio. have been submitted to and reported upon by the Boundary Commission of the Sounty of San Diego; and WHEREAS, the Boundary Commission of the County of San Diego has rpproved the boundaries of the proposed annexation; and WHERXAS, the City Clerk of the City of Carlsbad has certified to the Xty Council that the territory proposed to be annexed is uninhabited, now, her e fo r e, The City Council of the City of Carlsbad DOES HEREBY RESOLVE as 01 lows : IT IS HEREBY DECLARED that the City Council of the City of Carlsbac hat proceedings for the annexation hereinafter described have been initiated y the City Council of the City of Carlsbad; that the City Council does hereby eclare their reasons for initiating such proposed annexation to be as follows: 1. It appears to the satisfaction of the City Council the owners of land who represent a majority of the assessed valuation of the land within the area proposed to be annexed are desirous of having the City Council initiate proceedings to accomplish such annexation. 3 2 .i 4 F E 'i E s 1c 11 12 1: 14 1: le 17 1E 15 2c 21 22 22 24 2: 2E 27 2E 28 3c 31 32 2. proposed to be annexed, may be used in such a fashion so as to be contrary to the best interests of the City of Carlsbad. 3. That the City of Carlsbad is concerned that certain lands, That the area proposed to be annexed is within the boundaries of the Carlsbad Municipal Water District; that the municipal interest of the City of Carlsbad would be served by having the boundary of the Carlsbad Municipal Water District be coterminous with the City of Carlsbad when the same is desired by the property owners of the area proposed to be annexed to represent a majority of the assessed valuation within such area. 4. the City of Carlsbad so as to enable the City of Carlsbad to develop a more complete master street pian to serve the needs That the area proposed to be annexed is required to be in of the City of Carlsbad. BE IT FURTHER RESOLVED AND FOUND by the City of Carlsbad that the boundaries of the territory proposed to be annexed by the City of Carlsbad are as follows: All that unincorporated area in the County of San Diego, State of California, being all of Lot K and all of unnumbered Tract North of Lot J of the Rancho Agua Hedionda, according to Map thereof No. 823, recorded in the office of the Recorder of said San Diego County, a portion of the fractional Section 32, Township 11 South, Range 4 West, San Bernardino Base & Meridian, and a portion of the fractional Section 33, Township 11 South, Range 4 West, San Bernardino Base & Maridian, and being more particularly described as follows: 1. Beginning at the intersection of the Westerly Line of said Lot J of the Rancho Agua Hedionda, said Westerly Line being also the Easterly Line of said fractional Section 32, with the Easterly Boundary Line of the City of Carlsbad; 2. Thence Northeasterly along said Westerly Line of Lot J and said Easterly Line of fractional Section 32 to the most Westerly Corner of said unnumbered Tract North of said Lot J; 3, Thence along the Southerly Line of said unnumbered Tract North of said Lot J South 59O East 3775,20 feet to an angle point in said Southerly Line; Tract North 67O East 3861 feet more or less to point No. 2 inthe Easterly Line of said Lot J of the Rancho Agua Hedionda, as shown on said Map No. 823, said Easterly Line being also the existing Boundary Line of the City of Oceanside; 4. Thence Northerly and Westerly following along said existing Boundary Line of the City of Oceanside to its point of intersection with the Northerly Prolongation of the Easterly Boundary Line of the City of Carlsbad, said Easterly Boundary Line being also the Westerly Line of Road Survey No. 925 as shown on a map thereof filed in the office of the Surveyor of said San Diego County; 6. Thence Southerly along said Prolongation and said Easterly Boundary Line of the City of Carlsbad and the Westerly Line of Road Survey No. 925, to the POINT OF BEGINNING. BE IT FURTHER RESOLVED that the territory herein proposed to be annexed shall be, and the same is hereby designated "EAST CARLSBAD ANNEXATION #2.1". BE IT FURTHER RESOLVED AND DECLARED that hearing will be held on Tuesday the 3rd day of June, 1958, at the Council Chambers in the City Hall, 2960 Pi0 Pice Drive, Carlsbad, California, at the hour of 7:30 o'clock P.M., for the purpose of hearing persons interested in or objecting to the proposed annexation. At any time before the hour set for hearing, objections of any owner of property within the territory proposed to be annexed may file written protest against the annexation, The written protest shall state the name of the owner of the property affected, and the description and area of the protestant's property in general terms. BE IT FURTHER RESOLVED that the City Clerk is hereby- directed to publish this resolution twice in the Carlsbad Journal, published in Carlsbad, California, and also in the Blade-Tribune , published in Oceanside, California, on April 24, 1958 and May 1, 1958; the City Clerk is further directed to cause written notice of the proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed, is assessed in the last equalized County Assessment Roll available on the date hereof, at the addressc shown on each assessment roll or as known to the Clerk, and also to any person who has filed his name and address and designation of the lands in which he has any interest, either legal or equitable, with the Clerk. The City Clerk is further directed to cause written notice of this proposed annexation to he mailed to the Board of Supervisors of the County of San Diego and the California State Highway Division. The City Clerk is fhrther directed to cause written notice of this proposed annexation to be mailed to the Carlsbad Union School District, Tri-City Hospital District, Oceanside -Carlsbad Union 11 1 1, 1' 18 1' I( I' Ir l! 2( 2: 2; 2: 2.4 25 26 27 2E 29 3c 31 32 High School District, Carlsbad Municipal Water District, Carlsbad Municipal Water Improvement District No. 1, San Diego County Water Authority, M etropolitan Water District and Agua Buena Soil Conservation District; and the notices heretofore required to be given by the City Clerk shall be completec on or before the 1st day.of May, 1958. 0 PASSED, APPROVED AND ADOPTED by the City Council of the City of Carhbad at a regular meeting of the City Council held on the 15th day of April, 1958, by the following vote, to wit: AYES: Mayor Baird, Councilwoman Sonneman, Councilmen Ledgerwood, NOES: None Helton and Lough.
