Q RESOLUTION' NU. 419 A RESOLUTION OF OF THE CITY OF C AND DECLARING F , AND REJECT- ING AN APPEBL FROM THE VARIANCE GRANTED BY TEU3 PLANNEWG COMMISSION TO LILLIAN M. GARRETT. WHEREAS, on June 12, 1958, WILLARD D. and LllLLIAN M. GaRRETT applied for a variance of the rear yard set back (south side) of Lot 41 of Gran- ville Park in the City of Carlsbad; and WHEREAS, notice of the public hearing of the proposed variance was published on the 13th day of June, 1958; and WHEREAS, on the 24th day of June, 1958, the Planning Commission of the City of Carlsbad held and conducted a duly advertised hearing on said proposed variance; and WHEREAS, at said meeting of the Planning Commission, Resolution No. 76 was adopted wherein the variance was granted as requededj and WTEREAS, on the 30th day of June, 1958, a written appeal was received by the City of Carlsbad from Robert Kolb, Eddie R. Vasquez, Hazel B, Robinson, Jane E. Johnston, Margaret S. Anderson and Marjorie H. Burke, which appeal in effect requested the City Council of the City of Carlsbad to deny the grant of variance to WILLARD D. and LILLIAN M. GAREETT; and WHEREAS on July 2, 1958, notice of a public hearing on said appeal was published; and WHEREAS, on July 15, 1958, a public hearing was held in the City Hall of the City of Carlsbad, 2960 Pio Pic0 Drive, Carlsbad, California, at 7:30 o'clock P. M., at which time the appeal was considered by the City Council and evidence and arguments were presented by all interested parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, and it is so found by the City Council of the City of Carlsbad, that the following facts and reasons require that the variance, as granted by the Planning Commission, be sustained so as to carry out the general purpose of Ordinance No. 9060; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 1€ 1s 2c 21 2: 2; 24 2: 2t 2‘ 2t 2! 3( 3: 3, a. That approximately all lots in Granville Park are substandard, and or effective utilization thereof, have restorically required variances, or will ier eafter require the grant of variances; b. That a similar variance has been granted to adjacent property, where such adjacent property abuts the subject pm‘operty; and c. That the grant of variance by the Planning Commission does not lepreciate or devaluate the surrounding properties. BE IT FURTHER RESOLVED, that for the foregoing reasons, the appeal .s hereby denied. BE IT FURTHER RFSOLW3D, that the City Clerk, be, and he is hereby 3irected to cause a certified copy of this resolution to be mailed to the xppellants, and a copy of this resolution to be attached to the Planning Zommission file and returned to the Planning Commission for permanent riling. PASSED, APPROVED AXD ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 15th day of July, 1958, by the Eollowing vote, to wit: AYES: Mayor Lough, Councilmen Ledgerwood, Helton and Grober and Councilwoman Sonne man.
