RESOLUTION NO. 440
RESOLUTION OF INTENTION OF THE
CITY COUNCIL OF THE CITY OF CARLSBAD TO MODIFY THE MASTER
CIVIC CENTER PLAN OF THE CITY OF
CARLSBAD, BY EXCLUDING CERTAIN
AREAS THEREFROM.
WHE.REAS, on the 4th day of March, 1958, the City Council of the City
of Carlsbad adopted Resolution No. 349 entitled "Resolution of the City Counci:
of the City of Carlsbad adopting a Master Civic Genter Plan for the City of
Carlsbad"; and
WHEREAS, since said date the City of Carlsbad has received requests
for amendment of said Master Civic Center Plan; and
WHEREAS, pursuant to Section 65501 of the Government Code of the
State of California, the Planning Commission is required to hold a hearing
on the proposed amendment, and pursuant to Section 65509 the City Council
of the City of Carlsbad is required to hold one hearing on the action of the
Planning Commission with respect to the proposed amendment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
Section 1. IT IS HEREBY RESOLVED AND DECLARED to be the
intention of the City of Carlsbad to consider the amendment of the Master
Civic Center Plan of the City of Carlsbad by deleting therefrom the following
described proper ties :
Parcel 1. Assessor's Parcel No. 35-45-3, being a portion of
Carlsbad Lands, Tract 117, more particularly described as
follows:
Beginning on the northerly line of Tract 117, north 89O 57'
west 358.58 feet from the northeast cornerj thence north
89O 57' west 108 feet; thence south 34O 33' east 250.58 feet;
thence north 55O 27' east 88.90 feet; thence north 34O 33'
west 189.55 feet to point of beginning.
Parcel 2. Assessor's Parcel No. 35-45-4, being a portion of Carlsbad Lands, Tract 117, more particularly described
as follows:

the provisions of Section 65501 to 65507 of the Government Code of the State

PASSED, APPROVED AND BPDOPTED by the City Council of the City
of Carlsbad at a regular meeting of the City Council held on the 16th day of
September, 1958, by the following vote, to wit:
SECTION 2. The Planning Commission of the City of Carlsbad is
hereby directed to hold a hearing on the proposed amendment pursuant to
