RESOLUTION NO, 458
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD GRANTING A VARIANCE ON LOTS "L", "M" AND "N",
IM BLOCK "I" OF THE MAP OF PALISADES IN THE CITY OF CARLSBAD.
WHEREAS, on the 14th day of October, 1958, the Planning Commission
of the City of Carlsbad adopted Resolution No. 87, which denied a variance
applied for by SMITH & CASTELA, ASSOC. ; and
WHEREAS, on the 20th day of October, 1958, Smith and Castela, Assoc
appealed to the City Council to review the action of the Planning Commission;
and
WHEREAS, on the 5th day of November, 1958, the City Council of the
City of Carlsbad, at a duly advertised hearing, considered said appeal, and
made the following findings:
1. That the variance applied for would be consistent with
the required set back for single lot set back;
2. That the remaining unimproved lots have a rear yard
set back of 12 feet or less; and
3. The granting of the variance would not be detrimental
to the remaining property in the area.
WHEREAS, the action of the City Council was referred to the Planning
Cornmission and a further report requested from the Planning Commission; a
WHEREAS, on the 14th day of November, 1958, the Planning Commissi
made their report to the City Council of the City of Carlsbad,
NOW, THEREFORE, the City Council of the City of Carlsbad does
hereby find that the granting of the variance is necessary to carry out the
general purpose of Ordinance No. 9060, as amended, for the following reasor
a. That the variance applied for would be consistent with the
required set back for single lot set back;
b. That the remaining unimproved lots have a rear yard
set back of 12 feet or less; and
c. That the granting-of,the variante-would not b
to the remaining property in the area.
the rear lot set back from 20 feet to- 12 feet.
BE IT FURTHER RESOLVED AND ORDERED that the City Clerk be
ordered to send a duly certified copy of this resolution to the applicant at
the address shown on the application for variance; that a copy hereof be mailec
to any other parties requesting notice of this action, and that a copy be
attached to the Planning Commission file and made a permanent part thereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad held on the 18th day of November, 1958, by
The City Council of the City of Carlsbad does hereby RESOLVE AND
ORDER that a variance be, and the same is hereby granted on Lots "L",
, Block "I", Map of Palisades in the City of Carlsbad, changing llpJLt! and f!N"
