WHEREAS, on July 1, 1958, JAMES A, SCANLON applied for a variance; and WHEREAS, thereafter proceedings were held pursuant to Ordinance No. 9060; and WHEREAS, the City Council of the City of Carlsbad. has considered said matter, and IT IS HEREBY FOUND AND DECLARED as follows: 1. The fence has been constructed for more than one year prior to the time that the property owner was notified of the violation of the zoning ordinance. 2. That there are other fences in the area of similar height. 3. That the granting of the appeal, overruling the action of the Planning Commission, would not be contrary to the best interest of the City of Carlsbad. 4. general purposes of Ordinance No. 9060. The granting of the variance is necessary to carry out the The City Council of the City of Carlsbad DOES HEREBY RESOLVE that JAMES A. SCANLON be, and he is hereby granted a variance on the property located on the northwest corner of Laguna Avenue and Ebwood Street, permitting him to maintain a fence thereon at the height of 72 inches, in accordance with the application for variance on file with the City Clerk of the City of Carlsbad. IT IS FURTHER RESOLVED AND ORDERED that the City Clerk send a copy of this resolution to James A.
