The City Council of the City of Carlsbad DOES HEREBY RESOLVE
as follows:
t, The City Council of the City of Carlsbad does herewith request
from the State of California, Department of Natural Resources, Division of
Small Craft Harbors, acting by and tkaugh the Small Craft Harbors Commisn
sion, that they entertain and receive an application from the City of Carlsbad
for a loan of construction loan funds in an amount not to exceed $700,000.00,
2. R. L, Patterson, Consulting Engineer, 2823 Newport Blvd,,
Newport Beach, California, is hereby retained and employed by the City of
Carlsbad for the purpose of preparing said loan application, and to sign the
same for and in behalf of the City of Carlsbad,
3. The Mayor of the City of Carlsbad, Mr, R, L. Patterson, the
City Manager of the City of Carlsbad, and such other persons as may be
selected by the City Manager, are hereby authorized and instructed to appear
at a metting of the Small Craft Harbors Commission in Blythe, California,
on December 9, 1958, in support of said application,
4. The City Manager is authorized for and in behalf of the City of
Carlsbad to sign a contract between the City of Carlsbad and the State of
California, Department of Natural Resources, Division of Small Craft Harbor
fok the repayment of said loan,
5. The City Manager of the City of Carlsbad is hereby directed and
instructed to submit a report to this City Council setting forth the procedure
for the formation of a Harbor District of the territorial jurisdiction to be
embraced thereby,

6. In the event that the planning for the proposed development of
a small boat harbor at the Agua Hedionda Lagoon, Carlsbad, California, as
contained in that report submitted by R. L. Patter to the Board of Super-
visors of the County of San Diego in 1957, is not generally in accordance
with the "Specifications and Criteria for Planning Small Craft Harborsr' and
as a result thereof further plapuring is required, then said R, L. Patterson
is authorized and instructed to prepare an application for a loan of funds
for planning purposes only in an amount not to exceed $10,000.00.
7. The City Manager; and other persons appointed by him, are
hereby authorized and instructed, as an alternative to the foregoing loans,
to request that the Division of Small Craft Harbors prepare plans for, and
acquire, construct, develop and improve, a small craft harbor at the Agua
Hedioada Lagoon, Carlsbad, California, and facilities in
the City Council of the City of Carlsbad herewith expressing and stating that
it would be willing to assume the operation of such a harbor so constructed,
and to enter into an agreement for the repayment of all costs thereof, pursuan
to the provisions of Section 5823 of the Public Resources Code of the State of
California.
8. The City Clerk of the City of Carlsbad is hereby directed to
certify five (5) copies of this resolution, and forthwith mail. the same to the
Division of Small Craft Harbors, Department of Natural Resources, State of
California, Sacramento 14, California, Attention, H. G. Stevens.
PASSED, APPROVED AND PTED at a regular meeting of the
City Council of the City of Carlsbad held on the 2nd day of December, 1958,
by the following vote, to wit:
AYE23 Mayor Ledgerwood, Councilmen Grober and Belton, and Councilwoman Sonneman. NOES: Councilwoman Coats
