RESOLUTION OF Tm CITY COUNCIL OF THE
CITY OF CARLSBAD GRANTING A VARIANCE ON PROPERTY LEGALLY DESCRIBZD AS A PORTION
WEST, A PORTION OF THE EAST 1/2 OF THE SOUTHWEST 1/4, RZCORD OF SURVEY 841 AND RECORD OF SURVEY 2608, AND BEING A PORTION
OF TAX ASSESSOR'S PARCEL 6x2, BOOK 35, PAGE 167, OF THE ASSESSOR'S MAP OF SAN DIEGO
OF SECTION 31, TOWPJSHIP u SOUTH, RANGE 4

WHEIZEAS, on the 12th day of May, 1959, the Planning Commission of the
City of Carlsbad adopted Xesolution No. 118, which denied a variance applied
for by STERLING E, AND NORMA E. EVANS: and
wHER;EAS, on the 15th day of May, 1959, Sterling E. and Norma E, Evans
appealed to the City Council to review the action of the Planning Commission;
and
WHEREAS, on the 2nd day of Jme, 1959, the City Council of the City of
Carlsbad, at a duly advertised hearing, considered said appeal, and made the
following findings:

There were no objections from surrounding property owners.
The adjoining property has a 5 foot side yard set back.
Granting this variance will not be detrimental to property or
improvements in the neighborhood.
NOW, THEREFORE, the City Council of the City of Carlsbad does hereby
find that the granting of the variance is necessary to carry out the general
purpose of Ordinance No, 9060, as amended, for the following reasons:

The City Council of the City of Carlsbad does hereby RESOLVE AND ORDER
that a variance be, and the same is hereby granted on a portion of Section 31,
Township 11 South, Range 4 West, a portion of the East 1/2 of the Southwest 1/4,
Record of Survey 841 and Record of Survey 2608, and being a portion of Tax
Assessor's Parcel 6x2, Book 35, Page 167, of the Assessor's Hap of San Diego

County, changing the west side yard set back from 7 feet to 5 feet,
BE IT FURTHER RESOLVED AND ORDERED that the City Clerk be ordered to send
a duly certified copy of this resolution to the applicant at the address shown
on the application for variance; that a copy hereof be mailed to any other
parties requesting notice of this action, and that a copy be attached to the
Planning Commission file and made a permanent part thereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad held on the 2nd day of June, 1959, by the following
vote, to wit:
APES: Mayor Ledgerwood, Councilmen Grober and McPherson, and Councilwoman
NOES: None,
ABSENT: None,
ABSTAINING1 Councilwoman Coats.
