HomeMy WebLinkAbout1960-07-19; City Council; Resolution 6661 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NU, 666 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DENYING A VARXNC PEOPERTY LEGALLY DESCRIBEX) PORTION OF LOT 1, 532 IN THE CITY ADDITION* ACCORDING TO WHEREAS, on the 14th day of June, 1960, the Planning Commission of the City of Carlsbad adopted Resolution No. 165, which denied a variance applied €or by R. P. and LOIS V, SHEA; and WHEREAS, on the 23rd day of June, 1960, R. P. and Lois V. Shea wpealed to the City Council to review the action of the Planning Commission; and WHERmS, on the 19th day of July, 1960, the City Counqil of the City of Carlsbad, at a duly advertised hearing, considered said appeal; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad does hereby find that the denying of the variance is necessary to carry out the general purpose of Ordinance No. 9050 and Ordinance No. 9060 as amended, for the following reasons: I, The lots created by granting the variance would not meet the require- ments of Ordinance No. 9060 of the City of Carlsbad, and would be in direct violation of the provisions of Ordinance No. 9050 of the City of Carlsbad, 2, This lot split could only be achieved by amendment to Ordinance No. 9050 of the City of Carlsbad, to create a lot with no frontage on a dedicated street, and not by granting a variance. 3. The lots created by granting the variance would be detrimental to public welfare. 4. The property was acquired by the applicant in May, 1960, and it is presumed that the applicant was aware of the zoning restrictions on the propert at the time of the purchase. BE IT FURTHER RESOLVED AND ORDERED that a variance be, and I 2 3 4 5 6 7 €3 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3c 31 3% the same is hereby denied on a portion of Lot I, Cedar Hill Addition, according to Map thereof No, 532 in the City of Carlsbad, and being Tax Assessor’s Parcel 9, Book 35, Page 53 of the Assessor’s Map of San Diego County, for a reduction of minimum required lot frontage from 60 feet to 25 feet on one lot an( from 60 feet to 0 feet on a second lot to allow a lot split. BE IT FURTHER RESOLVED AND ORDERED that the City Clerk is hereby directed to send a copy of this resolution to the applicant at the address shown on the application for variance, and that a copy be attached to the Planning Commission file and made a permanent part thereof. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 19th day of July, 1960, by the following vote, to wit: AYES: Councilmen Guevara, Bierce,Sonneman and McPherson.
