HomeMy WebLinkAbout1960-08-02; City Council; Resolution 667.-. ... a 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIF- ORNIA* MAKING FINDINGS AND OVERRULING PROTESTS OBJECTIONS (Assessment District No, 1-1960) WHEREAS, this City Council by its Resolution No, 660 adopted on the 5th day of July, 1960, declared its intention to order the construction of cer- tain street improvements and appurtenances and appurtenant work under the Improvement Act of 1911, Division 7 of the Streets and Highways Code, and in said resolution fixed the 2nd day of August, 1960, at the hour of 7:30 P, M., in the Council Chambers of this City Council, as the time and place for the hear- ing before this City Council, of protests and objections; and WHEREAS, at the time and place fixed in said Resolution No. 660 a hearing was duly held by this City Council for hearing all written protests or objections; that the Clerk filed his certification with the City Council that no written protests had been filed; that the Clerk gave all persons present an opportunity to be heard in respect of any matter relating to the work proposed in said Resolution No. 660 or the boundaries of the assessment district described therein, or in any way related to the proceedings proposed by said Resolution No. 660; and WHEREAS, all persons desiring to appear and be heard have been heard and this City Council has taken evidence relating to said proposed work, the boundaries of the proposed assessment district and and the benefits to the property to be included in the proposed assessment district, and is fully informed in the premises; NOW, THEREFORE, the City Council of the City of Carlsbad, Californ: DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: Section I, That protests or objections have not been made by the owners of one-half of the area of the property to be assessed for said propose( work. Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of the assessment district are defined and established as the boundaries described in the resolution of intention, to wit: Resolution No. 660 and the work proposed to be done is likewise defined and established as the work described in said Resolution No. 660, and reference is hereby made to said Resolution No. 660 for a full and complete description of said work and of the assessment district and for further particulars. Section 4. That this resolution shall be entered upon the minutes of this City Council. PASSED, APPROVED AN3 ADOPTED on the 2nd day of August, 1960, by the following vote, to wit: AYES: Councilmen Guevara, Bierce, Sonneman and McPherson.
