A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD OVER- RULING ALL PROTESTS ON THE ASSESS- MENT, CONFIRMJJYG THE ASSESSMENT AND CONFIRMING THE REGULARITY OF PROCEEDINGS.
(Assessment District No. 5-1959)
WHEREASa on the ILth day of July, 1960, the Ehgineer of Work filed

with the City Clerk of the City of Carlsbad his assessment to represent the
cost and expense of the work and improvement for the work done upon those
streets and properties in the City of Carlsbad, ordered by Resolution No. 630
of the City of Carlsbad, and as said work and improvement was done by
Don Hubbard Contracting Co,, said work being more particularly described in
Resolution of Intention No. 624; and
WHEREAS, the City Clerk of the City of Carlsbad has duly given notice
of publication, posting, and mailing in the time and manner provided by law
of the filing of said assessment and of the time of hearing thereon; and
WHEREAS, the City Council of the City of Carlsbad has taken said
assessment under consideration and has received all oral and documentary
>% evidence, and any and all protests, relating to the assessment, proceedings
heretofore had, and the proper completion of the work and improvement for
which the assessment has been issued.
NOW, THEREFORE, IT IS H.EXEBY RESOLVED by the City Council
of the City of Carlsbad that all protests, iv any, as the same appear upon the
minutes of the City Council of the City of Carlsbad at the date set for hearing,
be, and they are hereby overruled.
BE IT FURTHER RESOLVED that all proceedings prior to the date of
hearing, relating to said assessment, and a11 acts and determinations of all
officers and employees of the City of Carlsbad, in relation to said assessment,
be, and the same are hereby ratified and confirmed.
BE IT FURTHER RESOLVED that said assessment and the diagram
and warrant attached thereto, be, and the same is hereby confirmed by the
City Council of the City of Carlsbad,

BE IT FURTHER RESOLVED that the Engineer of Work is hereby
ordered to deliver said warrant, assessment and diagram to Don Hubbard
Contracting Co,, the Contractor, forthwith upon the payment by him of the
balance of the incidental expenses due thereon, and the warrant shall bear
the date of this order,
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting of the City Council held on the 16th day of
August, 1960, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, Sonneman and McPherson,
NOES: None
ABSENT: Councilman La Roche.
