HomeMy WebLinkAbout1960-09-06; City Council; Resolution 6841 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 684 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CABLSBAD ANNOUNCING FJNDn'JGS AND DECLSIOW GMNT3NG THE APPEAL AND DENYING A VARIANCE ON PROPERTY DESCRIBED AS A PORTION OF TRACT NO. 2, LAGUNA MESA TRACTS, ACCORDING TO WIAP TMEREDF NO. 1719 OF THlE CITY OF CARLSEKQ, WHEREAS, on the 26th day of July, 1960, the Carlsbad City Planning Commission adopted Resolution No. 170 granting a variance on property more fully described therein as a portion of Tract No. 2 of Laguna Mesa Tract, according to Map thereof No. 1719 of the City of Carlsbad, which resolution is herewith referred to; and WHEREAS, a appeal of the decision of the Planning Commission, which granted said variance, was filed with the City Clerk by Iva M. Grober in accordance with Ordinance No. 9060 of the City of Carlsbad; and WHEREAS, the Carlsbad City Council did publish a legal notice of hearing on August 4, 1960 of a hearing to be held on August 16, 1960 at 7: 30 P. M. ; and WHERIEAS, the public hearing was held by the said City Council on August 16, 1960, and at saia public hearing the City Council received the recommendations, objections, protests and comments of all individuals and parties who desired to be heard; NOWa THEREFORE, the City Council of the City of Carlsbad does hereby find that the variance should not be granted for the following reasons: 1. The granting of this variance would be contrary to all the setback requirements of Ordinance No. 9060; 2. A precedent would be set for all the remaining properties on the street; and 3. When Jefferson street is improved to its full right of way width, a definite traffic hazard will be created. IT fs HEREBY DECLARED by the City Council of the City of Carlsbad that the appeal herein is granted and the variance of Donald A. Briggs, Jr,, for a variance for reduction of front yard from- 20 feet to 2 feet, reduction of rear yard from 20 feet to no rear yard, and an increase of side yards from 10 feet 8 1 4 1 ! f r t < I( 13 1: 1: 14 2: 17 I& 15 2c 21 22 23 24 25 26 27 28 29 30 31 32 to 15 feet on three lots lying on the west side of Jefferson Street between Las Flores Drive and the Freeway be, and the same is hereby denied. P-ED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 6th day of September, 1960, by the following vote, to wit: AYES: Councilmen Guevara, Sonnemarr and McPherson, NOES: Councilman Bierce. ABSENT: None ABSTAINED: Councilman La Roche, ATTEST: ,i. i NOTE: This resolution failed to pass for lack of a 4/5ths affirmative vote. -2-
