(Assessment Distri ct NO. 1-1960) WHEREAS, this City Council by its Resolution No, 701, adopted on the 1st day of November, 1960, declared its intention to order certain changes in the street improvements and appurtenances and appurtenant work under the Improvement Act of 1911, Division 7 of the Streets and Highways Code, and in said resolution fixed the 15th day of November, 1960, at the hour of 7:30 P,M., in the Council Chambers of this City Council, as the the and place for the hearing before this City Council, of protests and objectionsj and '\ WHEREAS, at the time and place fixed in said Resolution No. 101 a hearing was duly held by this City Council for hearing all written protests or objectionsj that the Clerk gave all persons present an opportunity to be heard in respect of any matter relating to the changes of work proposed in said Resolution No. 701 or the boundaries of the assessment district described therein, or in any way related to the proceedings proposed by said Resolution No. 6- or Resolution No. 701; and WHEREAS, all persons desiring to appear and be heard have been heard, and this City Council has taken evidence relating to said changes in the propose work, the boundaries of the proposed assessment district and the benefits to the property to be included in the proposed assessment district, and is fully informed in the premises; NOW, THEREFORE, the City Council of the City ,of Carlsbad, Californi: DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: Section 1. That protests or objections have not been made by the owners of one-half of the area of the property to be assessed for said proposed work. Section 2. The City Council. finds and determines that no protests or objections have been made. ~ Section 3. That no changes are to be made in the boundaries of the proposed assessment district as defined in Resolution No, 660, and the 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and the boun boundaries of the assessment district are defined and established as the boundaries described in the resolution of intention, to wit: Resolution No, 660, and the work proposed to be done is likewise defined and established as the work described in said Reskutian No, 660 and Resolution No, 701, and 1 reference is hereby made to said Resolution No. 660 and Resolution No, 701 for a full-and complete description of said work and of the assessment district and for further 'particular S. 1 Section 4. That the public Merest and convenience require and the City Council of said city hereby orders the following changes of work to be done In the street improvement on Chestnut Avenue, known as Assessment District NO. 1-1960, to wit: (1) Delete the type '%" curb and gutter on the south side of the Chestnut Street improvement from StaJwlon 35+6 8.90 to Station 38.f. 36.9 3, (2) Delete the 4" P. C. C, sidewalk on the south side of the said improvement from Station 35+68.90 to Station 38*36.9 3, (3) Delete the 4" V,C,P. laterals at Stations 364-01.87, 36w8.97, 37+38..07 and 38+03.17. (4) Delete the excavation in the area from the lip of proposed southerly curb and gutter to t4e southerly property line from Station 35+68,.90 to Station 38+36.9 3. Reference is hereby made to said Resolution No. 660 and Resolution No. 701 and to plans (which include profiles and detailed drawings) for said work and changes in work which are designated "Construction Plans for the hprovemenf of Chestnut Avenue between Pi0 Pic0 Drive and Monroe Street", Qn file in the office of the City Clerk of said City, and to specifications €or said work which are designated "Specifications No. 131960, also on file in the of€ice of said City Clerks for a more particular description of said work and change in work. Section 5.
