RESOLUTION NO, 723
A RESOLUTION OF THE CITY OF
CARLSBAD FINDING A PORTLON OF
OAK AVENUE UNNECESSRY FOR
PRESEXT OR PROSPECTIVE PUBLIC STWET PURPOSES; VACATING SUCH PORTION OF .OAR AVXNUE; AND ORDERING CLERK TO RECORD A CERTIFIED COPY HEREOF WITH THE COUNTY RECORDER OF SAN DIEGO
COUNTY.
WHEREAS, on the 7th day of February, 1961, the City Council of the City
of Carlsbad adapted Resolution No. 719, stating its intention to vacate the
property herein vacated, and setting a time and place of hearing; and
WHEREAS, the City Engineer has posted notices stating street vacation
and date of hearing in accordance with the provisions of Section 8332 of the
Streets and Highway Code of the State of Californiaj and
WHEREAS, at 7r30 ohdock P.M. on February 21, 1961, the City Council
of the City of Carlsbad held a hearing at its regular meeting place in the
City of Carlsbad at 2960 Pi0 Pic0 Drive; and
WHEREAS, all persons who were interested in or opposed to the street
vacation were heard,
NOW, THEREFORE, the City Council of the City of Carlsbad does hereby
find that that portion of Oak Avenue hereinafter described is unnecessary for
present or prospective public street purposes.
The City Council of the City of Carlsbad DOES HEREBY RESOLVE
as follows:
1. That the following described lands shall be, and are hereby vacated,
said lands being more particularly described as follows:
That portion of Oak Avenue between Harding Street and State Highway X1-SD-2-B described as follows:
Beginning at the Northwest corner of Lot 1, Carlsbad Lands Subdivision, Tracts 114 and 120, Map 1744, in the City of Carlsbadj thence North 55" 27' East 560.00 feet; thence
South 85" 36% 27" West 19.904 feet; thence South 55O 27' West 532.78 feet to the beginning of a 10.00 foot radius curve concave Southeasterly and having a central of 90B OOu 00"; thence Southwesterly along said curve a distance of 15.71 feet to the
POINT OF BEGLNMNG.

2. The City Clerk shall be, and he is hereby instructed to cause a
certified copy of this resolution to be recorded in the office of the County
Eecorder of San Diego County,
PASSED,. APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad held on the 21st day of February, 1961, by the
following vote, to wit:
AYES: Councilmen Guevara, Bierce, Sonneman, McPherson and La Roch
