VASQUEZ. WHEREAS, on March 29, 1961, EDDIE R. VASQUEZ did apply for a variance for reduction in front yard setback from 20 feet to 5 feetj east side yard from 10 feet to 5 feet; rear yard setback from 20 feet to IO feet 6 inches and to create one uncovered and paved off-street parking space to the westerly lot line of lot 43 and to tke front lot JizlR of saXd lot in order to convert a dwell- ing into a 4 unit apartment, on property located on Ocean Street between Mountain View and Garfield Streets, more particularly described as Lots 42 and 43 Granville Park according to map thereof No, 1782 irZ the City of Garlsba and being Tax Assessorps Parcel 32, Page 56, Book 35 of Assessorb Map of San Diego County; and WHEREAS, notice of the public hearing of the proposed variance was published on the 30th day of March, 1961; and WHEREAS, on the 11th day of April, 1961, the Planning Commission of the City of Carlsbad held and conducted a duly advertised hearing on said proposed variance; and WHEREAS, at said meeting of the Planning Commission ResaluWon No. 205 was adopted wherein the variance was granted as requested3 and WHEREAS, on the 20th day of April, 196% a written appeal was received by the City of Carlsbad fram Willard D. and LUan M, Garrett* which appeal in effect requested the City Council of the City of Carlsbad to deny the grant of variance to Eddie R. Vasquezj and WHEREAS, on May 4, 196 1, notice of a public hearing on said appeal war published1 and WHERE%& on May 16, 1961, a public hearhg was held in the City Hall of the City d Carlsbad, 1960 Pi0 Pico Drive, Carlsbad, Califor&, at 7:30 oFclock P. M,, at which time the appeal was considered by the Cit;y Council and evidence and arguments were presented by all interested parties. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 22 24 25 26 27 2e 29 3c 31 32 NOW, THEREFORE, BE IT RESOLVED by the City Comcil of the City of Carlsbad, and it is SQ found by the City Council of the City of Carlsbad, that the following facts and reasons require that the variance, as granted by the Planning Commission, be sustained so as to carry out the general purpose of Ordinance No. 9060: 1, That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by ofier property in the same vicinity and zone but which is denied to the property in question, 2. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located, 3. That the granting of such variance will not adversely affect the comprehensive general plan. BE IT FURTHER RESOLVED,. that for the foregdng rea$ons, the appea is hereby denied. BE IT FURTHER RESOLVED, that the City Clerk, be, and he is herebg directed to causa a certified copy of this resolution to be mailed to the appellants, and a copy of this resolution to be attached to the Planning Com- mission file and returned to the Planning Commission for permanent filing. PASSED, APPROWD AND ADOPTED at a regular meemg of the City Council of the City of Garlsbad held on the 16th day of May, 1961, by the following vote, to wit: AYES: Councilmen Guevara, Bierce, La Roche and McPhersoh NOES: Councilwoman Someman.
