RESOLUTION NO. 754
A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL TO VACATE A
PORTION OF BIRCH STREET IN THE CITY
OF CARLSBAD BETWEEN CERTAIN DESIG- NATED POINTS; AND ESTABLISHING A TIME AND PLACE OF HEARING,
The City Council of the City of Carlsbad does hereby resolve as follows:
SECTION 1. The procedure for the vacation of a portion of Birch Street
between certain designated points in t4e City of Carlsbad, shall be, and the
same is hereby ordered to be in accordance with the proceedings set forth
in the Street Vacation Act of 1941, contained in Sections 8300 to 8374 of the
Streets and Highways Code of the State of California.
SECTION 2. It is hereby resolved and declared to be the intention of
the City Council to vacate a portion of Birch Sfreeta more particularly des-
cribed as follows:
Beginning at a point on the Nortlxwesterfy he of Lot 15 of said Carlsbad mghlands, Unit No,. 2, said point being the Southwesterly terminus of the arc of a 25 foot radius curve concave Southerly, being also the point of intersection of said North- westerly line of Lot; 75 with the Southwesterly line
of said Birch Avenue; thence along said Southwesterly
Urze of said Birch Avenue North 48" 50* 40'' West 32.10 feet; thence leaving said Southwesterly line Morth 72" 28f' 50" East 34.68 feet to the beginning of a
tangent 20 foot radius curve concave Southwesterly;
thence Easterly along the zu'c of said curve 31.41 feet through a central angle of 90 degrees; thence tangent to said curve South 17" 31T 10" East 28..77 feet to a point on the Westerly line of Sunnyhill Drive as shown on said above mentioned map No.
28251 thence Westerly dong the arc of said afore- mentiwed 25 foot radius curve 52.94 feet through
a central angle of 121" 19' 30" to the point of
beginning+.
the details of such proposed vacation being more specifically set forth in a
map and plan in the office of the City Clerk.
SECTION 3. The City Council of the City of Carlsbad hereby establishes
as the date for hearing all persons interested in, or objecting to, the proposed
vacatian* at 7:30 ofclack P.M. on July 5, 1961, at its regular meting place
in the City Hall in the City of Carlshad, 2960 Pio Pic0 Drive, Carlsbad,

SECTION 4+- The City Engineer is hereby order dto p st notices
of street vacation as herein proposed, conspicuously along the line of the
street or parts thereof, proposed to be vacated, with said posting to be
accomplished at least ten (10) days before the 5thlday,of July, 1961.
notices shall be posted not more than three hundred (300) feet apart, wiwl at
least three (3) being posted upon the poraons of street proposed to be vacated,

and shall state the time and place of hearing of persons interested h, or

SECTION 5, The City Clerk is hereby ordered and directed to cause
this resolutiun ta be published once in the Carhbad Journal, a weekly news-
paper of general circulation in the City of Carlsbad,
PASSED, APPROVED AND ADOPTED hy the City Council of the City
of Carlsbad at a regular meeting held on the 6th day of June, 1961, by the
