RESOLUTION NO. 7 63
A RESOLUTJON OF THE CXTY COWNCXL OF
THE CITY OF CARL FXNDING A PORTION OF BIRCH UE WMNECESSARY FOR PRESENT OR PROSPECTIVE PUBLIC STREET PURPOSES; VACATQYG SUCH PORTION OF BXEbCH AVENUE$ AND ORDERING CLERK TO RECORD A CERTIFIED COPY
HEREOF WITH THE COUNTY RECORDER OF SLUT DIEGO COUNTY.
WHEREAS, on June 6, 1961, the City Council of the City of Carlsbad
vacated, and setting a time and place of hearing; and
WHEREAS, the City Engineer has posted notices stating street vacation
and date of hearing in accordance with the provisiom of Section 8332 of $he
Streets and Hghway Code of the State of California; and
WHEREAS, at 7:30 otc1ock F.M. on July 5, 1961, the City Council of the
City of Carlsbad held a hearing at its regular meeting place in the City of
Carlsbad at 2960 Pi0 Pic0 Drive3 and
WHEREAS, all persons who were interested In or opposed to the
street vacation were heard;
NOW, THEREFORE, the City Council of the City of Carlsbad does
hereby find that that portion of Birch Avenue hereinafter described is unneces-
sary for present or prospective public street purposes.
The City Council of the City of Carlsbad DOES HEREBY RESOLVE
as follows:
l*- That the following described lands shall be, and are hereby
vacated, said lands being more particularly described as follows:
Beginng at a point on the Northwesterly line of Lot 75 of said Carlsbad Highlands, Udt No. 2, said point being the Southwesterly terminus of the
arc of a 25 foot radius curve concave Southerly, being also the point of intersection of said North- westerly he of Lot 75 with the Southwesterly line of said Birch Avenue3 thence along said Southwesterly line of said Birch Avenue North 48" 50' 40" West 32,lO feetj thence leaving said Southwesterly line North 72" 28%-50" East 34,68 feet to the beginning of a tangent 20 foot radius curve concave Sauihwesterly; thence Ewterly along the arc of said curve 31.41 feet through a central angle of 90 degrees; thence

tangent to said curve South 17" 3lf East 28,.77 feet to a point on the Westerly Line: of Sumyhill
Drive as shown on said above mentioned map No.
2825; thence Westerly along the arc of said ,afme-
mentioned 25 foot radius curve 52.94 feet through
a central angle of 121" lgF 30" to the point of
beginning,
the details of such proposed vacation being more specifically set forth in a
map and plan in the office of the City Clerk.
2. The City Clerk shall be, and he is hereby instructed to cause a
certified copy of this resolution to be recorded in the office of the County
Recorder of San Diego County.
PASSED,, APPROVED AND ADOPTED at a regular meetlng of the
City Council of the City of Carlsbad held on the 5th day of July, 1961, by the
following vote, to wit:
AYES1 Councilmen Guevara, Bierce, La Roche, Sameman and
NOES: None McPherson
ABSENT! None
