RESOLUTION NO, 766
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CABLSBAD, AUTHOR- IZING THE MAYOR OF CARLSBAD TO EXECUTE THE BASIC AGREEMENT BETWEEN THE FGS.TA SAHITATION DISTRICT AND THE CITY OF CABLSBAD FOR ACQUISITXON AND CONSTRUCTION OF A JOINT SEWErER SYSTEM,
WHEREAS, there is an urgent need in Vista and Carlsbad for additional
sewage collection, transmission, treatment and disposal facilities to meet
the requirements of their respective expanding populations; and
WHEREAS, each of the parties hereto is empowered by law to provide
for the transmission, treatment and disposal of sewage and is authorized to
contract with the other as set forth in this Basic Agreement; and
WHEREAS, the City Council of the City of Carlsbad finds that it is Ip the
interest of the public health and safety in Carlsbad to enter into an agreement
pursuant to Chapter 5, Division 7 of Title I of the Government Code facthe
joint exercise of powers in the acquisition, construction and operation of a
joint sewer systemj
NOW, THEREFORE, the Mayor of the City o€ Carlsbad, WILLIAM J.
LA ROCHE, is hereby authorized to execute the Basic Agreement beween the
Vista Sanitation District and the City of Carlsbad for acquisition and construc-
tion of a joint sewer system on behalf of the City of Carlsbad,
PASSED, APPROVED AND ADOPTED by the City Comcll of the City
of Carlsbad, at a regular meeting held on the 18th day of July, 1961, by the
following vote, to wit:
AYES: CounciLmen Guevara, BLerce, La Roche, Sonneman and
NOES: None
McPherson.
ABSENT: I!lOne
