RESOLUTION NO, 768
A RESOLUTION OF THE CITY COUNCfl
OF THE CITY OF CARLSBAD, CALIFORSYJ
AWARDING CONTRACT FOR WORK OR IMFROVEMENT ORDERED OLUTION
NO. 761 OF SAID CITY CO
(Assessment District No. 1-1961)
WHEREAS, this City Council, on the 5th day of July, 1961, duly adopted
Resolution No, 761 ordering the following work to be done or llmprovement to
be made, to wit, all that certain work or Improvement described in Resolution
No. 752, duly adopted by this City Council on the 6th day of June, 1961; and
WHEREAS, pursuant to and in accordance with said Resolution No, 761,
a notice inviting sealed bids or proposals for doing said work or improvement
was duly published and posted; and
WHEREAS, at the hour of 1:OQ o'clock P. M., August I, 1961, at the
Council Chambers of the City Council of the City of Carlsbad, 2960 Pi0 Pico
Drive, Carlsbad, California, all sealed bids or proposals €or said work, which
were delivered to the City Clerk, were publicly opened, examined and declared
by the City Clerk; and
WHEREAS, the City Clerk submitted his report of the result of said
bidding to the City Council of the City af Carlsbad on August 1, 1961, the
regular meeting of the City Council next succeeding the date of the opening of
the bids; and
WHEREAS, this City Council finds that said resolutions were duly adoptec
and contained the matters and things required by law and that all notices
required by law have been duly given and all hearings required by law duly
held and that each and every step in the proceedings prior to and including the
opening of said bids has been duly and regularly taken and that this City CounCi.
has duly acquired jurisdiction;
NOW, THEREFORE, the City Council of the City of Carlsbad, Califor&
DOES HEREBY RESOLVE, DETZRMINE: AND OFCDER as follows:
Section 1. That this City Council does hereby determine that the bid of
DON HUBBARD CONTRACTING COMPANY, Encinitas, California,

is the lowest regular bid for said work of any responsible bidder and that said
bid is accompanied by a good and sufficient proposal guaranty which is saffs-
factory to this City Comcil, and this City Councfl does hereby award the con-
tract for said work to the above named bidder, at the prices named in the bid
of said bidder. All bids or proposals for said Work, other than said lowest
regular bid above accepted, are hereby rejected.
Section 2, That the City Clerk is hereby directed tu publish twice in
the CARLSBAD JOURNAL, a newspaper of general circulation published and
circulated in the City of Carlsbad, a notice of this award. Said notice shall
contain the matters and things required by law and shall be published in the
manner required by law.
PASSED, APPROVEXI AND ADOPTED at a regular meethg of the City
Council held on the 1st day of August, 1961, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, La Roche, Sonneman and McPhersor
NOES: None
