RESOLUTION NO. 821
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD TO INITIATE ON ITS OWN MOTION PROCEED- INGS TO ANNEX CERTAIN UNINHABITED
TERRITORY.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CARLSBAD:
1. That the Council of the City of Carlsbad, for the reasons hereinafter
mentioned, proposes to initiate on its own motion, as soon as it can legally do
so, proceedings to annex to the City of Carlsbad all of the territory hereinafter
described, as uninhabited territory, under provisions of the Annexation of
Uninhabited Territory Act of 1939 as set ferth in Sections 35300 to 35325,
inclusive, of the Government Code of the State of California.
2. That. the Councills reasons for proposing to initiate said annexation
proceedings are as follaws: The annexation of the hereinafter described territoi
will contribute to the orderly growth of the city, provide the proper control of
street layout, drainage, sanitary sewer design, and insure the proper use of
land in conformity with the overall zoning plan of the city.
3. That the territory which the Council proposes to annex is hereby
identified as ItEast Carlsbad Annexation No. 2.2", and consists of all that real
property situate in the County of San Diego, State of California, described in
Exhibit "A", attached hereto and made a part hereof as if fully set forth herein.
4. That the City Clerk af the City of Carlsbad is hereby directed to file
with the Boundary Commission of the County of San Diego, State of California,
this propasal to initiate proceedings to annex the described uninhabited territory
set. forth in Exhibited "A" attached hereto, to the City of Carlsbad, and to
request a report by the Commission as provided for in Section 35002 of the
Zovernment Code.
