HomeMy WebLinkAbout1962-06-06; City Council; Resolution 8231 2 7 a. 4 5 6 7 8 9 10 11 12 13 14 3.5 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 823 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ADOPTING THE PRECISE PLAN OF SAN DIEGO GAS & ELECTRIC CO. OPERATING CENTER, SUBJECT TO CERTAIN CONDITIONS AND RESTRICTIONS. WHEREAS, on the 8th day of May, 1962, the Planning Commission of the City of Carlsbad adopted Resolution No. 243, recommending the adoption of the precise plan of the San Diego Gas & Electric Co. Operating Center, a copy of which precise plan is attached hereto and marked "Exhibit A", and made a part hereof; and WHEREAS, on June 6, 1962, a duly advertised hearing was held by the City Council of the City of Carlsbad, at which time the City Council considered the recommendations of the Planning Commission, heard all persons interested in or opposed to the adoption of the precise plan, and considered all factors relating to the adoption thereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the precise plan, marked "Exhibit A", attached hereto, entitled Precise Plan of San Diego Gas & Electric Co. Operating Center", is hereby ir adopted as the precise plan for the area shown and described in said "Exhibit A' subject to the following conditions and restrictions: (a) That the request to rezone that area designated on the precis plan for park purposes is hereby denied. (b) That the proposed future entrance across from Tierra del Oro is hereby eliminated from the precise plan and denied. (c) All of the wall along the westerly portion of the area shown on the precise plan as being 4. 67 feet in height shdU be 6 feet in height. (d) Curb and gutters shall be placed on Carlsbad Boulevard from the entrance to the operating center area to Terramar Drive to include curb return at the intersection of Carlsbad Boulevard and Terramar Driv (e) Operations at the operating center shall be restricted to the f I 4 ! (f) The City of Carlsbad shall accept the park with plantings, with the condition that seed and water be furnished by the San Diego Gas and Eleckric Co. (g) Use of the loud speaker shall be prohibited between the hour The speaker shall be directc of 5:OO o'clock P. M. and 8:OO o'clock A. M. away from the residential area and the volume maintained at an absolute minimum to eliminate nuisance to surrounding residences. (h) The emergency gate on Terramar Drive shall be locked except in cases of disaster. (i) The wall on Terramar Drive shall be set back 20 feet from the property line. 2. It is hereby ordered that the City Manager and persons working under his direction are assigned the duties of enforcing and requiring compliance witk the requirements of said precise plan. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 6th day of June, 1962, by the following vote, to wit: AYES: Councilmen Guevara, Bierce, McPherson and Hughes NOES: Councilman Neiswender ATTEST: '4 1 /-7 $ E.
