RESOLUTION NO. 824
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD ANNOUNCING
FINDINGS AND DECISION REGARDING CHANGE OF ZONE CLASSIFICATION OF CERTAIN PROPERTY IN THE CITY OF CARLSBAD FROM ZONE R-1 TO ZONE "M".
WHEREAS, on the 8th day of May, 1962, the Carlsbad City Planning
Commission adopted Resolution No. 243, which is herewith referred to and mad
a part hereof; and

WHEREAS, on June 6, 1962, a duly advertised public hearing was held
by the City Council as prescribed by law to consider the reclassification from
Zone R-1 to Zone af property described as:
The Westerly 700 feet of the Southerly 400 feet of
that certain portion of Lot H of Rancho Agua Hedionda, in the County of San Diego, State of California, accord- ing to Partition Map thereof No. 823, filed in the office of the County Recorder of San Diegs County, November 16, 1896, as conveyed to the San Diego Gas & Electric Campany by deed dated September 23, 1948, and recorded October 8, 1948, Document No. 100051, in Book 2974, Page 493, of Official Records of said County of San Diego, lying Easterly of the Easterly right of way line of former State Highway
XI-SD-2B {now known as Carlsbad Boulevard);
and
WHEREAS, the City Council received all recommendations and heard all
persons interested in or opposed to the proposed change of zone classification.
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Plannin
Commission contained in Resolution No. 243 constitute the findings of the City
Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certified that the approval of the proposed change of zone classification is
necessary to carry out the general purpose of Ordinance No. 9060 as amended.
BE IT FURTHER RESOLVED that the City Council does hereby declare
its intention to adopt an erdinance to effectuate the proposed change of zone
classification.
BE IT FURTHER DECLARED AND ORDERED that the City Attorney
is hereby instructed to prepare an ordinance amending Ordinance NQ. 9060 to

effectuate the change of zone classification,
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council held on the 6th day of June, 1962, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, McPherson and Hughes.
NOES: Councilman Neiswender
ABSENT: None
