A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPOINTING PERSON TO ACT AS ENGINEER OF WORK, DESIGNATING ENGINEER OF WORK AS THE PERSON RESPONSBLE FOR PREPARATION OF THE ENGINEERING DOCUMENTS, ASSESS- MENT DIAGRAMS, ASSESSMENT ROLL &ND WARRANT; DESIGNATING THE ENGZNEER OF WORK TO SUPERVBE ALL WORK3 APPOINT- JNG ENGINEER OF WORK AS THE SUPERIN- TENDENT OF STREETS AND FMING COMPEN- SATION FOR SERVICES. (Proposed Assessment Distrist No. 1-1962) of such work and improvements. BE IT FURTHER RESOLVED that said Lowell A. Rathbun, Ehgineer of Work, is hereby appointed to act in the name, place and stead of the 32 RESOLVED by the City Council of the City of Carlsbad that LOWELL A. RATHBUN be, and he is hereby appointed Engineer of Work for the proposed doing of all necessary engineering work and exercising all of the functions provided for the office of Engineer of Work ad Superintendent of Streets in the "Improvement Act of 1911" in connection with the improvement work in the City of Carlsbad, and to be known as the improvement of a portion of Chinquapin Avenue, between Garfield and the A. T. & S. F. Railway Company westerly right-of-way line. BE IT FURTHER RESOLVED that said Lowell A. Rathbun shall act as Engineer of Work and Superintendent of Streets and is hereby employed and appointed to furnish all surveys, origiml drawings, maps and blue prints, including any and aU such maps necessary and incident to the rights of way contemplated in the improvement work herein involved; all plans and specifica- tions, all inspection workj preparation of assessment rolls, assessment 1 2 3 4 5 6 7 8 9 10 bl 12 13 14 15 3.6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Superintendent of Streets", as such name and title appears under the provisiom rt af the Improvement Act of 1911". BE IT FURTHER RESOLVED that for such services that the said LOWELL A, RATHBUN, acting in his capacity as Engineer of Work and Superintendent of Streets, shall receive as and for his compensation for the services so specifi and as provided by law, the following compensation, which shall consist a€ the following sums of money: (a) Six percent (6%) of the contract price for engineering services. (b) Two percent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant. BE IT FURTHER RESOLVED that of the compensation so allowed to said Lowell A. Rathbun as provided by law, shall be payable to the General Fund of the City of Carlsbad. BE IT FURTHER RESOLVED that said sum shall be based upon the contra price without incidentals, and in the event the proposed proceedings herein mn- templated shall be defeated or for any reason fail of consummation, the said Lowell A. Rathbun shall be paid a reasanable compensation for his services whi he has performed, and which in no event shall be less than $100.00. BE IT FURTHER RESOLVED that the fees herein provided to be paid to the said Engineer shall be payable as follows: (a) Three-fourths (314th~) of the Engineering fee upon awarding and signing of contract for the work. (b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the assessment and dellvery of the warrant. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 7th day of August, 1962, by the following vote, to wit: AYES: Councilmen Guevara, Bierce, McPherson, Neiswender and Hughes, NOES: None ABSENT: None ATTEST: J.
