HomeMy WebLinkAbout1962-08-07; City Council; Resolution 8434 F % f F t r 1 E 5 1c 11 12 12 14 15 1E 17 .le 19 20 21 22 23 24 25 26 27 28 29 30 3;L 32 RESOLUTION NO. 843 A RXSOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING ITS INTENTION TO GRANT A FRANCHISE TO SAN DIEGO PIP'EGINE COMPANY FOR THE RIGHT TO CONSTRUCT, MAINTAIN, OPERATE, AFIEPAIR, REI\TEW AND REMOVE PIPE LINES FOR THE TRANSPORTATION OF OIL, GAS AND OTHER SUBSTANCES THEREOF IN AND ACROSS PUBLIC HIGHWAYS IN THE CITY OF CARLSBAD; FIXING A TIME AND PLACE FOR A Hl3ARING THEREON AND PROVIDING FOR THE PUB- LICATION OF SAID HEARING. WHEREAS, on July 27, 1962, SAN DIEGO PIPELINE COMPANY, a California corporation, made application to the City Council of the City of Carlsbad for a franchise as more particularly described in Section 1 hereof. NOW, THERWORE, BE IT KESOLVED by the City Council of the City of Carlsbad as follows: SXCTION 1. That the City Council hereby declares its intention to grant a franchise for a period of forty (40) years from and after the date of passage of the ordinance granting such franchise to construct, maintain, operate, repair, renew, and remove pipe lines for the transportation of crude oil petroleum, together with natura gasoline, gas, liquid hydrocarbon substances, and other liquid and gaseous substances contained in said crude oil petroleum, in and under all public streets and highways now or hereafter dedicated to public use in incorporated portions of the City of Carlsbad, County of San Diego, State of California. SAN DIEGO PIPELINE COMPRiW, its successors and assigns, will pay to the City of Carlsbad during the life of this franchise two percent (2%) of its gross annual receipts arising from the use, operation and possession of the franchise. SECTION 2. That the 4th day of September, 1962, at 7:BO o'clock p.m. of said day, iF€lTFCouncil Chamber in the City Hall of the City of Carlsbad, California, is the time and place fixed for hear- ing all persons interested in or objecting to the proposed granting of said franchise. SECTION 3. That the City Clerk of the City of Carlsbad is hereby directed to publish notice of said hearing at least once within fifteen (15) days after the passage of this resolution in the published and circulated in the City of Carlsbad this 7th day of August, 1962.
