(Proposed Assessment District No. 2-1962) RESOLVED by the City Cauncil of the City of Carlsbad that LOWELL A. RATHBUN be, and he is hereby appointed Engineer of Work for the proposed doing of all necessary engineering work and exercising all of the functions provided for the office of Engineer of Work and Superintendent of Streets 131 the "Improvement Act of 1911" in connection with the improvement work in the City of Carlsbad, and to be known as the improvement of Harding Street from its intersection with Grand Avenue to its intersection with Magnolia Avenue; Oak Avenue, Chestnut Avenue, Palm Avenue with their intersections with Harding Street to their terminus with State Highway XI-SD-2Bj Pine Avenue from its intersection with Madison Street to its terminus with State Highway XI-SD-2B; and Magnolia Avenue from its intersection with Jefferson Street to its terminu with State Highway XI-SD-2B; and BE IT FURTHER RESOLVED that said LOWELL A. MTHBUN shall act as Engineer of Work and Superintendent of Streets and is hereby employed and appointed to furnish all surveys, original drawings, maps and blue prints, including any and all such maps necessary and incident to the rights of way contemplated in the improvement work herein involved; all plans and specifi- cations, all inspection work, preparation of assessment rolls, assessment diagram and warrant and any and all other services which shall be required from the Engineer of Work and/or Superintendent of Streets under the provi- sions of the "Improvement Act of 1911"j and BE IT FURTHER RESOLVED that for such services that the said Lowell A. Rathbun acting in his capacity as City Engineer of the City of Carlsba shall receive as and for his compensation for the services so specified, and as provided by law, the following compensation, which compensation shall be payable to the General Fund of the City of Carlsbad, and shall consist of the following sums of money: 1 2 c c 4 c 6 7 8 9 10 11 12 23 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 {a) Six per cent (6%) of the contract price for engineering services. (b) Two per cent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant. BE IT FURTHER RESOLVED that said sum shall be based upon the contract price without incidentals; and in the event the proposed proceedings herein contemplated shall be defeated or for any reason fail of consummation, the said Lowell A. Bathbun of the City of Carlsbad shall not receive any compensation; and BE IT FURTHER RESOLVED that the fees hereinabove provided to be paid to the said Engineer shall be payable as follows: (a) Three-fourths (3/4ths) of the Engineering fee upon awarding and signing of contract for the work. \ (b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the Assessment and delivery of the Warrant. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 7th day of November, 1962, by the following vote, to wit: AYES:Councilmm Guevara, Bierce, McPhersorz, Nefswender and Hughe, NOES: None ABSENT: None of the City of Carlsbad, Carlsbad, California Y ATTEST: aH. \- PRICE, City clerk -2 -
