HomeMy WebLinkAbout1963-03-05; City Council; Resolution 8781 2 3 4 5 6 7 a 9 10 11 12 1: 14 3.E 1E 17 1E 15 2c 21 22 .2 2 24 25 2E 27 2€ 2s 3c 31 32 RESOLUTION NO. 878 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ANNOUNCING AND DECLARING FINDINGS, AND DENYING THE APPEAL MADE BY MAUREEN MC INERNY RORICK FROM THE DECISION OF THE PLANNING COMMISSION CONCERNING RE- CLASSIFICATION OF CERTAIN PROPERTIES IN THE CITY OF CARLSBAD. WHEREAS, on January 8, 1963, MAUREEN MC INERNY RORICK applied for a reclassification from Zone R-A 10, 000 to Zone R-1-7580 on property located on the northerly side of Basswood Avenue between Canon Stree and Donna Drive in the City of Carlsbad; and WHEREAS, notice of the public hearing of the proposed reclassification was published on the lQth day of January, 1963; and WHEREAS, On the 22nd day of January, 1963, the Planning Commission of the City of Carlsbad held and conducted a duly advertised hearing on said proposed fedLassification; and WHEREAS, at said meeting of the Planning Commission, Resolution No, 281 was adopted wherein the request for reclassification was denied; and WHEREAS, on the 19th day of February, 1963, a written appeal was received by the City of Carlsbad from MAUREEN MC INERNY RORICK, whicl appeal in effect requested the City Council to consider the action of the Plannin Commission in denying the request for reclassification of the above-mentioned property; and WHEREAS, on February 21, 1965, notice of a public hearing on said appeal was published; and WHEREAS, on March Pa, 1963, a public hearing was held in the City Hall of the City of Carlsbad, 2960 Pi0 Pico Drive, Carlsbad, California, at 7:30 o'clock P. M., at which time the appeal was considered by the City Council and evidence and arguments were presented by all interested parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad that the findings of the Planning Commission in denying the request for reclassification be affirmed and that the appeal therefrom by applicant be denied for the following reasons: 1 2 7 c1 4 5 6 7 E s 1c 13 12 1: 14 1: 1C 1: 1E I! 2( 2: 2: .2: 21 2: 2t 2’ 2t 2I 3( 3: 3; (1) That because of the location of an R-A 10,000 square foot zone minimum adjacent to the proposed rezoning, the general welfare., will suffer by reducing the square footage requirement; and (2) That no public necessity and convenience exists for granting the proposed reclassification. BE IT FURTHER RESOLVED that for the foregoing reasons the appeal is hereby denied. BE IT FURTHER RESOLVED , that the City Clerk is hereby directed to cause a copy of this resolution to be mailed to the appellants, and a copy of this resolution to be attached to the Planning Commission file and returned to the Planning Commission for permanent filing. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 5th day of March, 1963, by the following vote, to wit: AYES: Councilmen Guevara, McPherson, Neiswender and Hughes.
