RESOLUTION NO. 886
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, APPROVING AND URGING THE ADOPTION OF CALIFORNLA
ASSEMBLY, 196 3, REGULAR SESSION, BILLS
NOS. 306 AND 462.
WHEREAS, Assembly Bills Nos. 316 and 462, introduced in the Californi
Legislature during the 1963 General Session, would have the effect of exempting
raw materials in the original packages when held by manufacturers, from
personal property taxes within the State of California; and
WHEREAS, said bills are in consonance with the long-he1.d exemptions
from taxation under the United States Constitution, which exemptions were
overturned by the United States Supreme Court decision in Youngstown Sheet
and Tube Company vs. Bowes, (1959); and
WHEREAS, said exemptions encourage commerce and industry and the
orderly industrial development of this area of California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
1. That the City Council of the City of Carlsbad does hereby go on recor
as favoring the passage of Assembly Bills Nos. 316 and 462 during the present
California Legislature Session.
2. That the City Clerk of the City of Carlsbad be and he hereby is
directed to send certified copies of this resolution to the Assembly Committee
on Revenue and Taxation; State Senator Schrade and State Assemblyman Ashcraf-
and the League of California Cities.
PASSED APPROVED AND ADOPTED by the City Council on the 19th
day of March, 1963, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, McPherson and Neiswender.
NOES: None
