HomeMy WebLinkAbout1963-04-26; City Council; Resolution 894RESOLUTION NO. 894 PRELIMINARY DETERMINATION OF LEGISLATIVE BODY ANDER "SPEC I AL ASSES SP!ENT INVEST I GAT I ON, LIMITATION AND MAJORITY PROTEST ACT OF 1931" (CHINQUAPIN AVENUE 1911 IMPROVEMENT DISTRICT) (Assessment District No. 1-1962) BE IT RESOLVED by the City Council of the City of Carlsbad that certain improvements are proposed to be done and made within the boundaries of the proposed assess- ment district hereinafter described within the City of Carlsbad, County of San Diego, State of California. In connection therewith, the City Council hereby finds and deter- mines as follows, to wit: 1, The nature of the propesed improvements consists of the construction of site clearing and grading, placing of base and paving, construction of curbs, gutters and sidewalks, installation of water mains, drainage facilities and other related items upon the streets or public ways hereinafter described within the City of Carlsbad, California, 2, The location and extent of the proposed improvements will involve the construction of the above-described improve- ments upon the following described public streets and public ways within the boundaries of the proposed assessment district hereinafter described, to wit: on a portion of Chinquapin Avenue extending from its intersection with Garfield Street to the Atchison, Topeka Santa Fe Railroad right of way as more particularly described on Drawing #135-8 of project 2-16 on file in the office of the City Clerk of Carlsbad, California, copies of which- are there open for inspection. 3. The boundaries of the district of lands proposed to be especially assessed to pay the costs and expenses of said proposed work and improvement are as shown upon the assessment -1- plat entitled, Assessment District 1-1962 Plat, Project #2-16, Drawing #135-EA consisting of one sheet on file in the office of the City Clerk of the City of Carlsbad, California, copies of which are open for inspection, which map or plat indicates by a boundary line the territory to be included in the proposed assessment district, and which map or plat governs for all details as to the extent of the district. 4, The percentage of the cost of said proposed improve- ment upon benefitted property is as follows: 70% of said costs to be assessed upon benefitted property, and 30% of said costs to be contributed by the City of Carlsbad. 50 The statute under which it is proposed to conduct proceedings for the improvement proceedings is the "Improvement Act of 1911" of the State of California with Improvement Bonds to be issued as authorized under the provisions of the"1mprove- ment Act of 1911." 60 The proposed work to be done is described upon the ,--- A>- plans and specifications adopted by Resolution No. 893 which 'Y ) are on file with the City Clerk of the City of Carlsbad, and said plans and specifications are hereby referred to for all particulars relative thereto and are open to inspection by anyone I- interested PASSED AND ADOPTED by the City Council of the City of Carlsbad at a special meeting held this 26th day of April , 1963, by the following vote, to-wit: - AYE s : Councilmen McPherson, Bierce, Guevara, Neiswender and Hughes.
