RESOLUTION NO. 897.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, REQUESTING A LOAN FROM
THE SMALL CRAFT HARBORS OF THE STATE OF CALIFORNIA* FOR THE PURPOSE OF PREPARING
PLANS FQR A SMALL CRAFT HARBOR, CERTIFYING THE CITY'S INTEREST IN CONTROL OVER THE
SUBJECT PROPERTY, AND CERTIFYING THAT
SECTIONS 6499.6 AND 5828 OF THE PUBLIC RE- SOURCES CODE HAVE BEEN COMPLIED WITH.
WHEREAS, pursuant to the authority of Division 5.7 of the Public
Resources of the State of California, the Division of Small Craft Harbors of the
State of California is enabled to make loans to cities for planning of small craft
harbors and facilities in connection therewith; and
WHEREAS, the City of Carlsbad wishes to make a loan from said Divisior:
with which to pay for preparation of such plans for the Agua Hedionda Lagoon,
situated in the City of Carlsbad, California; and
WHEREAS, the firm of DANIEL, MA.", JOHNSON, & MENDENHALL
has offered to prepare plans for construction of such a small craft harbor in
said lagoon, for the fee of $15,000.
NOW, THEREFORE, BE IT RESOLVED as follows:
I. That the City Council hereby requests a loan from the Division of
Small Craft Harbors of the State of California in the amount of $15, 000. 00, to
be used for the purpose of paying the firm of Daniel, Mann, Johnson, &
Mendenhall for preparing plans for a small craft harbor in the Agua Hedionda
Lagoon situated in the City of Carlsbad, California.
2. That the City Council hereby certifies as follows:
(a) That the said Agua Hedionda Lagoon is within the corporate
limits of the City of Carlsbad and is owned by the San Diego Gas &
Electric Company, which coixgany has expressed its willingness to
cooperate with the City of Carlsbad in the development of a plan for
the construction of said harbor, and has for some time through a
lease agreement permitted the City of Carlsbad to use the upper
and middle lagoon for recreational purposes.
(b) That Sections 6499.6 and 5828 of the Public Resources

Code of the State of California have been complied with.
(e) That the loan, if granted, will be used for the purpose
of preparing plans for a small craft harbor, said plans constituting
the first phase towards an uninterrupted completion of the entire
project, which project, when completed shall be available to the
public on equal reasonable terms.
3. That John D. Slater, City Manager of the City of Carlsbad be, and
he is hereby authorized to make all necessary applications, sign all necessary
documents and attend all necessary hearings on behalf of the City of Carlsbad
for the purpose of securing said loan.
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Carlsbad at a regular meeting held on the 7th day of May, 1963, by the following
vote, to wit:
AYES: Councilmen McPherson, Bierce, Guevara and Neiswender.
NOES: None
ABSENT: Councilman Hughes.
