HomeMy WebLinkAbout1963-05-21; City Council; Resolution 8981 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 .2 3 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 898 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE CLASSIFICATION OF CERTAIN DESIGNATED PROPERTY IN THE CITY OF CARLSBAD FROM ZONE R-A IO, 000 TO ZONE R-1-7,500, R-1-9,000 AND R-A IO, 000. WHEREAS, on the 23rd day of April, 1963, the Carlsbad City Planning Commission adopted Resolution No. 293, setting forth their findings; and WHEREAS, on May 7, 1963, a duly advertised public hearing was held as prescribed by law to consider the reclassification from Zone R-A-10,000 (Residential Agricultural) to Zone R-1-7, 500, R-1-9, 000 and R-1-10, 000 of certain designated property in the City of Carlsbad; and WHEREAS, the City Council received all recommendations and heard all persons interested in or opposed to the proposed change of zone classifica- tion. NOW, THEREFORE, the City Council of the City of Carlsbad DOES HEREBY DECLARE FINDINGS AND RESOLVE as follows: 1. That the following described lands shall be reclassified from Zone R-A-IO, 000 to R-1-7,500: That portion of Lot 7 Section 32, T 11 S, R 4 W, SBM and that portion of Tract 124 Carlsbad Lands as per Map No. 1661 records of San Diego County, California, in the City of Carlsbad and more particularly described as follows: Beginning at the intersection of the centerline of Monroe Street (60 feet wide) with the centerline of Basswood Avenue (60 feet wide) as said streets are shown on Belladonna Heights Unit No. 1 Map No. 3955 records of said San Diego County; thence South 30" 09' 40" West, 18.94 feet to the true point of beginning; thence North 61" 26' 18" West, 138. 05 feet; thence North 30" 09' 40" East, 705. 85 feet; thence North 12" 49I 55" West, 86. 30 feet; thence South 72" 54I 20" West, 147.00 feet; thence North 17' 05I 20" West, 580. 00 feet; thence North 31" 57* 30" East, 214. 51 feet; thence North 3' 47I 30" East, 265.86 feet; thence North 89" 10' 50" West, 520.52 feet; thence South 1" 27' 43" West, 997. 91 feet; thence North 89" 03* 25" West, 551.60 feet; thence South 19* 35' 46" East, 614.43 feet; thence South 61Q 26' 18'' East, 821.01 feet, to a point in the centerline of said Basswood Avenue; thence North 30" 09* 40" East along the centerline of said Basswood Avenue 270. 31 feet to the true point of beginning. Beginning at the intersection of Monroe Street and Basswood Avenue as shown on Belladonna Heights, Map No. 3955 records of said San Diego County; thence North 30" 09* 40" East, 683. 06 feet along the centerline of said Basswood Avenue; thence North 59@ 50' 20" West 138.00 feet; thence South 309 09' 40" West 705.85 feet; thence South 61" 26* 18" East 138.05 feet to a point in the centerline of said Basswood Avenue; thence North 30" Q9* 40" East, 18.94 feet along the centerline of said Basswood Avenue to the point of beginning. Beginning at the Northwesterly corner of Lot 13 of Falcon Heights Unit No. 1, Ma No. 4415 records of said San Diego County; thence South 72" 54* 40' West, 24. 81 feet; thence South 12" 49* 55" East, 86. 30 feet; thence South 59" 50f 20" East, 138.00 feet to a point in the centerline of Basswood Avenue (60 feet in width) as shown on said Map No. 4415; thence North 30" 09* 40" East, along the centerline of said Basswood Avenue, 81. 34 feet; thence North 59" 50' 20" West along the Southwesterly boundary line of said Lot 13 and the Southeasterly prolongation thereof, 180.00 feet to the point of beginning. Basis of Bearings for this description is the centerline of Basswood Avenue North 30° 09I 40" East as per said Map No. 4415. BE IT FURTHER DECLARED AND RESOLVED that the City Council certifies that the approval of the proposed change of zone classification is necessary to carry out the general purpose of Ordinance No. 9060 as amended. BE IT FURTHER RESOLVED that the City Council does hereby declare its intention to adopt an ordinance to effectuate the proposed change of zone c 1 as s if i c at ion. BE IT FURTHER DECLARED AND ORDERED that the City Attorney is hereby instructed to prepare an ordinance amending Ordinance No. 9060 to effectuate the change of zone classification. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 21st day of May, 1993, by the following vote, to wit: AYES: Councilmen McPherson, Bierce, Guevara and Neiswender.
