A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, STATING THE EXTENT OF THE LICENSE GRANTED TO THE TAKING OF SHELL FISH FROM LEASED AREA OF THE AGUA HEDIONDA LAGOON. WHEREAS, the City is the legal occupant of certain property including the water thereon in the area of the Agua Hedionda Lagoon in the City of Carlsbad, California, from the San Diego Gas & Electric Co. ; and WHEREAS, California Penal Code Section 602(g) makes the taking of shell fish without the license of the owner or legal occupant from such areas a misdemeanor; and WHEREAS, the City wishes to state the extent of the license it grants to the taking of shell fish from said area; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. The City hereby licenses members of the public to take shell fish from said area for use as bait on the day of the taking by the person so taking. 2. The City hereby declines to license and states its policy in opposition to licensing the taking of shell fish from said area for commercial purposes or for any purpose other than as stated above. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad, at a regular meeting of said Council held on the 4th day of June, 196 by the following vote, to wit: AYES: Councilmen Bierce, Guevara, Neiswender and Hughes.
