RESOLUTION NO. 924
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, PURSUANT TO SECTION 4770 OF THE HEALTH AND SAFETY CODE OF THE STATE OF CALIFORNIA, CON-
SENTING TO CONSTRUCTION OF SEWERS AND
APPURTENANCES IN PUBLIC STREETS AND HIGHWAYS WITHIN THE CITY OF CARLSBAD,
WHEREAS, the City of Carlsbad by contract dated July 13, 1961, entered
into a Joint Exercise of Powers Agreement with the Vista Sanitation District for
acquisition of and construction of a joint sewer system, being San Diego County
Contract No. 1858-21293; and
WHEREAS, the plans for said system require the construction of certain
parts thereof in portions of public streets and highways within the City of Carlsl:
and
WHEREAS, Section 4770 of the Health and Safety Code of the State of
California, requires that a resolution of the Carlsbad City Council consenting to
said construction be obtained; and
WHEREAS, the City Council desires to have the required parts of said
system constructed in portions of public streets and highways within the City of
Carlsbad;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad that consent be, and it is hereby granted to the Vista Sanitation
District, in its capacity as a party to said Joint Excercise of Powers Agreemen
to construct, within the City of Carlsbad, sewers and appurtenances in the
public streets and highways pursuant to said Joint Exercise of Powers Agree-
ment, as amended, and the plans and specifications thereof.
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Carlsbad, California, at a regular meeting held on the 2nd day of July, 1963,
by the following vote, to wit:
AYES: Councilmen McPherson, Bierce, Guevara, Neiswender and Hughes
NOES: None
ABSENT: None
