HomeMy WebLinkAbout1963-10-01; City Council; Resolution 9443 2 Li 4 e 7 E S IC I1 12 32 14 le I€ 17 1E 1s 2c 23 22 2: 24 2: 2t 2: 21 2! 3 3 3 RESOLUTION NO. 944 A RESOLUTION OF THE CITY COUNCIL OF THE: CITY OF CARLSBAD APPOINTING PERSON TO PREPARE ALL PROCEEDINGS, RESOLVED that STUART C, WILSON, be, and he is hereby appointed LS attorney to prepare all resolutions, notices and other papers and proceedings 'or any work and improvement that may be hereinafter authorized by the City Zouncil of the City of Carlsbad for the proposed improvement of Assessment Xstrict No. 1-1963 in said City of Carlsbad; and BE IT FURTHER RESOLVED that the said Stuart C. Wilson shall .eceive as compensation for the doing and performance of said work the sum of rwo Percent (2%) of the contract price, not including incidentals; but in no even1 ;hall the amount of compensation, which the said Stuart C. Wilson shall receive )e less than ONE HUNDRED DOLLARS ($100.00) ; and BE IT FURTHER RESOLVED that said compensation shall be paid as 'ollow s: (a) Three-fourths (3/4ths) at the time d signing the contract with the contractor who may be awarded said contract by this Body. (b) The balance thereof at the time of recording the Warrant, diagram and assessment; tnd BE IT FURTHER RESOLVED that if said proceedings shall fail to carry hrough to conclusion, then the said Stuart C. Wilson shall be paid a -easonable compensation for his services which he has performed, which in io event shall be less than $100. 00. BE IT FURTHER RESOLVED that said services shall not include any ;ervices for litigation or services in the procurement of easements or rights of vay, but shall be for the preparation of all resolutions, notices and other paper5 md proceedings required by the provisions of the trImprovement Act of 1911'' n carrying through the proceedings for the work herein contemplated. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 1st day of October, 1963, by the following vote, to wit: AYES: Councilmen McPherson, Bierce, Guevara, Neiswender and Hughe; NOES: None ABSENT: None ..
