RESOLUTION NO. 945
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPOINTING PERSON TO ACT AS ENGINEER OF WOFE# DESIGNATING ENGINEER OF WORK AS THE PERSON RESPONSIBLE FOR PREPARATION
OF THE ENGINEERING DOCUMENTS, ASSESS- MENT DIAGRAMS, ASSESSMENT ROLL AND WARRANT; DESIGNATING THE ENGINEER OF WORK TO SUPERVISE ALL WORK; APPOINT-
ING ENGINEER OF WORK AS THE SUPERIN-
TENDENT OF STREETS AND FIXING COMPEN- SATION FOR SERVICES,
(Proposed Assessment District No. 1-1963)
RESOLVED by the City Council of the City of Carlsbad that LOWELL A.
RATHBUN be, and he is hereby appointed Engineer of Work for the proposed
doing of all necessary engineering work and exercising all of the functions
provided for the office of Engineer of Work and Superintendent of Streets in
the "Improvement Act of 1911" in connection with the improvement work in
the City of Carlsbad, and to be known as the improvement of Hemlack Avenue
from the centerline of Garfiled Street easterly to the westerly right-of-way line
of the Atchison, Topeka and Santa Fe Railway Company.
BE IT FURTHER RESOLVED 'that said Lowell A. Rathbun shall act as
Engineer of Work and Superintendent of Streets and is hereby employed and
appointed to furnish all surveys., original drawings, maps and blue prints, '
including any and all such maps necessary and incident to the rights of way
contemplated in the improvement work herein involved; all plans and specifica-
tions, all inspection work, preparation of assessment rolls, assessment
diagram and warrant and any and all other services which shall be required
from the Engineer of Work and/or Superintendent of Streets under the pro-
visions of the ltImprovement Act of 1911"; and
BE IT FURTHER RESOLVED that said Lowell A. Rathbun ia hereby
appointed as the person to supervise, inspect, and accept in behalf of the
City of Carlsbad the installation, construction, performance and completion
of such work and improvements.
BE IT FURTHER RESOLVED that said Lowell A. Rathbun, Engineer of
Work, is hereby appointed to act in the name, place and stead of the "Superin-

tendent of Streets", as such name and title appears under the provisions of the
Improvement Act of 19 1 Z ".
BE IT FURTHER RESOLVED that for such services that the said LOWEL
A RATHBUN, acting in his capacity as Engineer of Work and Superintendent
of Streets, shall receive as and for his compensation for the services so specifit
and as provided by law, the following compensation, which shall consist of the
following sums of money:
(a) Six percent (6%) of the contract price for engineering services.
(b) Two percent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant.
BE IT FURTHER RESOLVED that of the compensation so allowed to said
Lowell A. Rathbun as provided by law, shall be payable to the General Fund of
the City of Carlsbad.
BE IT FURTHER RESOLVED that said sum shall be based upon the conk
price without incidentals, and in the event the proposed proceedings herein con-
templated shall be defeated or for any reason fail of consummation, the said
Lowell A. Rathbun shall be paid a reasonable compensation for his services whil
he has performed, and which in no event shall be less than $100.00.
BE IT FURTHER RESOLVED that the fees herein provided to be paid to
the said Engineer shall be payable as follows:
(a) Three-fourths (3/4ths) of the Engineering fee upon awarding and signing of contract for the work.
(b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the assessment and delivery of the warrant.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 1st day of October, 1963, by the
following vote, to wit:
AYES: Councilmen McPherson, Bierce, Guevara, Neiswender and Hughes NOES: None
