A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ANNOUNCING FINDINGS AND DECISION REGARDING CHANCE OF ZONE CLASSIFICATION OF CERTAIN DESIGNATED PROPERTY IN THE CITY OF CARLSBAD FROM ZONE R-1 TO ZONE R-3L. WHEREAS, on the 12th day of November, 1963, the Carlsbad City Planni Commission adopted Resolution No. 326, which is herewith referred to and madl a part hereof; and WHEREAS, on December 3, 1963, a duly advertised public hearing was held as prescribed by law to consider the reclassification from Zone R-1 (Single Family Residential) to Zone R- 3L (Limited Multiple -Family Residential) of property described as: and Portion of Th..i,m Lands, Tradk250, Map 1683. described as follows: Beginning at a point of intersection of the center line of County Avenue with the center line of Monroe Street; thence along said center line of Monroe Street, South 28" 39' East 433.98 feet to its intersection with the center line of Magnolia Avenue; thence along said center line of Magnolia Avenue; South 61" 21f West 406.51 feet to the most Easterly corner of the tract of land conveyed to William Boyes and Margaret Boyes by deed dated May 25, 1925 and recorded June 8, 1925 in Book 1095, page 150 of Deeds, records of San Diego County; thence North 28" 39' West along the Northeasterly line of said Boyes land, the pro- longation of said line, 637.62 feet to a point in the center line of County Avenue; thence along said center line of County Avenue North 87" 57' 30'' East 454.63 feet to the point of beginning. EXCEPTING that portion thereof which lies Southeasterly of a line which bears North 61" 21' East parallel with said center line of Magnolia Avenue from a point in the Southwesterly line of the above described land distant along said Southwesterly line North 28" 39' West 165 feet from said center line of Magnolia Avenue, in the City of Carlsbad, being Parcel 24, Book 205, Page 230, of the Assessor's Map of San Diego County; WHEREAS, the City Council received all recommendations and heard all persons interested in or opposed to the proposed change of zone classification. NOW, THEREFORE, the City Council of the City of Carlsbad DOES HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Planniq Commission contained in Resolution No. 326 constitute the findings of the City Council of the City of Carlsbad. BE IT FURTHER RESOLVED that the City Council does hereby declare its intention to adopt an ordinance to effectuate the proposed change of zone classification. BE IT FURTHE:R DECLARED AND ORDERED that the City Attorney is hereby instructed to prepare an ordinance amending Ordinance No. 9060 to effectuate the change of zone classification. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 3rd day of December, 1963, by the following vote, to wit: AYES: Councilmen McPherson, Bierce and Hughes.
