HomeMy WebLinkAbout1964-03-17; City Council; Resolution 9951 2 z 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 .2 3 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 995 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DENYING THE REQUEST FOR RECLASSIFICATION OF CERTAIN PROPERTY IN THE CITY OF CARLSBAD, FROM ZONE R-1 TO ZONE C-1. WHEREAS, on January 28, 1964, Nelson E. and Ida M. Westree applied for a reclassification from Zone R-1 to Zone C-1 on property located at the Northeast intersection of Las Flores Drive and Pi0 Pic0 Drive in the City of Carlsbad; and WHEREAS, notice of the public hearing of the proposed reclassification was published on the 30th day of January, 1964; and WHEREAS, on the 11th day of February, 1964, the Planning Commission of the City of Carlsbad held and conducted a duly advertised hearing on said proposed reclassification; and WHEREAS, at said meeting of the Planning Commission, Resolution No. 334 was adopted wherein the request €or reclassification was denied; and WHEREAS, on the 12th day of February, 1964, a written appeal was received by the City of Carlsbad from N. E. Westree, which appeal in effect requested the City Council to consider the action of the Planning Commission in denying the request for reclassification of the above-mentioned property; and WHEREAS, on February 20, 1964, notice of a public hearing on said appeal was published; and WHEREAS, on March 3, 1964, a public hearing was held in the City Hall 2960 Pi0 Pic0 Drive, Carlsbad, California, at 7:30 P. M., at which time the appeal was considered by the City Council and evidence and arguments were presented by all interested parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad that the findings of the Planning Commission in denying the request for reclassification be affirmed and that the appeal therefrom by applicant be denied for the following reasons: I 4 I 4 I t ! 1( 1: 1: 1: 1L 1: le 17 1E 1s 2c 21 2% .2 3 24 25 26 27 28 29 30 31 32 1. 2. That the property is close to well established R-1 residences. That the U.S. 101 Freeway plans are not firm so we do not know the location of the future off-ramp. 3. That although there is an off-ramp, there is no need for this rezoning since the improvements of the highway are some time in the future. BE IT FURTHER RESOLVED that for the foregoing reasons the appeal is hereby denied. BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to cause a copy of this resolution to be mailed to the appellants, and a copy of this resolution to be attached to the Planning Commission file and returned to the Planning Commission for permanent filing. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 17th day of March, 1964, by the following vote, to wit: AYES: Cmn.
