A RESOLUTION OF THE CITY OF
CARLSBAD ACCEPT1 NG EASEMENT
(VISTA SANITATION DISTRICT -
CITY OF CARLSBAD JOINT SEWER PROJECT) e
WHEREAS, there has been tendered to the City of Carlsbad an easement
€or sewer lines and appurtenances, together with an access road over and across
the property described therein, executed by the San Diego Gas and Electric
Zompany, a corporation, conveying to the Vista Sanitation District and the City
if Carlsbad, as tenants in common, an easement and right of way in, upon, unde
md across certain real property situated in the County of San Diego, State of
Zalifornia, and more particularly described in said easement, for the erection,
:ons truction, reconstruction, replacement, repair , maintenance and operation
)f a sewer pumping station, sewer pipeline, manholes, sewer lateral pipelines,
vith all the necessary equipment and appurtenance thereto, together with an
tccess road over and across the described lands, together with the right to
.lear and keep clear said easements from buildings, structures, materials, and
Ither hazards; and
WHEREAS, the grantor thereof has agreed to accept the sum of $1, 760. 00
s and for payment for the easement and right of way;
NOW, THEREFORE, on motion of Councilman Guevara J
econded by Councilman Atkinson a
IT IS RESOLVED AND ORDERED that said easement be and it is hereby
ccepted; that the City Clerk of the City of Carlsbad be, and she hereby is
uthorized to execute the acceptance of said easement for and on behalf of the
iity of Carlsbad; that the City Clerk of the City of Carlsbad be, and she is hereby
irected to transmit said easement to the Secretary of the Board of Directors of
ie Vista Sanitation District; and upon acceptance by said Board of Directors of
le Vista Sanitation District, the Secretary of the Board is directed to cause said
asement to be recorded in the Office of the County Recorder of San Diego County:

IT IS FURTHER RESOLVED AND ORDERED that the County Auditor of

the County of San Diego be directed to issue a County Warrant in the amount of
$1, 760. 00 payable to said grantor in consideration of granting said right of way.
IT IS FURTHER RESOLVED AND ORDERED that the Chairman of the
Board of Directors of the Vista Sanitation District is authorized to execute a
claim in favor of the San Diego Gas and Electric Company for the sum of
$1,760.00 as and for payment for said easement and right of way.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council held on the 5th day of May, 1964, by the following vote, to wit:
AYES: Councilmen Atkinson, Guevara, Neiswender, Jardine and Hughes.
NOES: None
