HomeMy WebLinkAbout1964-06-03; City Council; Resolution 1040RESOLUTION NO. 1040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF CARLSBAD OF UNINHABITED TERRITORY DESCRIBED HEREIN A.ND DESIGNATED "SOUTH CARLSBAD ANNEXATION NO. 1.5" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CARLSBAD: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Diegc was filed with the Council of the City of Carlsbad on June 3, 1964, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Carlsbad and which said City and its Council propose to annex, is situate in the County of San Diego, State of California, hereby designated South Carlsbad Annexation No. I. 5", more particularly described in Exhibit I1 , attached hereto and made a part hereof as if fully set forth herein. llAtf 3. That the County Boundary Commission of San Diego County, Califorr did in session duly assembled on March 16, 1964, consider the proposed an- nexation boundaries of said "South Carlsbad Annexation No. 1.5", as above described, and as submitted to said Commission by the proponents of said annexation. 4. That the Local Agency Formation Commission of San Diego County, California, did assemble on May 18, 1964, considered and approved the pro- posed annexation of uninhabited territory designated "South Carlsbad Annexati No. 1.5", as above described, and as submitted to said Commission by the proponents of said annexation. 5. That Tuesday, July 21, 1964, at the hour of 7r30 P. M. , in the Council Chambers in the City Hall in the City of Carlsbad, County of San Diego, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and # . ,, A*. . . : 5 4 s E 'i E 9 3.0 2.1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 SO 31 32 0 0 proposed to be annexed to the City of Carlsbad, and having any objections to the proposed annexation, may appear before the Council of the City of Carlsbad and show cause why such uninhabited territory should not be so annexed to the City of Carlsbad. before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. The protest must be in writing, may be filed at any the 6. The City Clerk of the City of Carlsbad is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Carlsbad Journal, a newspaper of general circulation published in said City of Carlsbad, the city to which it is proposed to annex the aforesaid territory, and also in the San Diego Union-Tribune, a newspaper of general circulation published outside the City of Carlsbad, but in the County of San Diego, California, the county in which is located the territory proposed to be annexed to the City of Carlsbad, said publication to be complete at least twenty (20) days prior to the date set for hearing. 7. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equal- ized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designatio1 of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 9. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county -2- D 3 4 d 13 1: It l! 2( 24 21 2' 2' 2 3 3 3 Fire Protection District, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to suck other persons as may be legally entitled thereto, in the manner required by law PASSED, APPROmD AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 3rd day of June, 1964, by the following vote, to wit: AYES: Councilmen Atkinson, Guevara, Neiswender, Jardine and Hughes. NOES: None ABSENT: None ATTEST: E City herk (SEAL) C arkbad,- California - 3- SOUTH CARLSBAD ANNEXATION 1.5 All that unincorporated area in the County of San Diego, State of Cal- ifornia, lying within the following described boundary lines: 1. 2, 3, 4, 5. 6. 7. a, Beginning at the intersection of the Northerly line of the South two-thirds of Lot 4 (Southeast Quarter of the Southeast Quarter) of Section 29, Township 12 South, Range 4 West, San Besnardino Base and Meridian with the Easterly Right of Way line of the Cal- ifornia State Highway XI-SD-2B as shown on State of California Department of Public Works, Division of Highways, District XI Right of Way Map No. LO 9628 to LO 9636; Thence along said Easterly Right of Way line South 19O 50' East 455,L9 feet to the beginning of a 6,UO foot radius curve concave Easterly; Thence Southerly along the arc of said curve through a central angle of 4" 55' 30", a distance of 526-06 feet; Thence tangent to said curve, south 24O 45' 30" East to the South- erly line of County Road Survey No, 339; Thence South 89O 49' East along the South line of said Road Survey No. 339 to the Easterly line of the ABANDONED portLon of the Atchi- son, Topeka and Santa Fe Railway Company's right of way across the said South two-thirds of said Lot 4, as shciw'n on Record of Survey Map No. 682 on file in the Recorder's Office of said County; Thence along said Easterly line of said Railway right of way North 4O 40' 18" West to an intersection with the Southwesterly line of the existing 200 foot Atchison, Topeka and santa Fe Railway right of way, as shown on State Board of Equalization Map 804-37-93 on file in the Assessor's Office of said County; Thence North 21O 08' 18" West along said Southwesterly line to an intersection with said Northerly line of the Southerly two-thirds of said Lot 4: Thence along said Northerly line North 89@ 49' 50" West to the point of beginning.
