A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ACCEPTING AND
APPROVING FIRST SUPPLEMENT TO AGREE- MENT BETWEEN VISTA SANITATION DISTRICT,
CITY OF CARLSBAD AND R, L, THIBODO CONSTRUCTION CO,, INC.
WHEREAS, the Vista Sanitation District, the City of Carlsbad, and I/
7 11 R. L. Thibodo Construction Co., Inc., have heretofore entered into an
Agreement for the construction of an outfall sewer, construction of a meter
station and pump station, for project bearing number W.O. 2785, on the 9th
day of July, 1963, said Agreement being designated No. 001-63-64; and
WHEREAS, R. L. Thibodo Construction eo., Inc., has completed the
construction pursuant to the terms of said contract, and said project has been
fully completed except for a visual inspection by the City of Carlsbad of the
interior of approximately 2, 000 feet of pipeline, which said inspection will not
be possible for several months; and
WHEREAS, R. L. Thibodo Construction eo. , Inc. , is desirous of
obtaining a release of a portion of the ten per cent (10%) retention payment
for said project prior to the time said inspection will be made, and the Vista
Sanitation District and the City of Carlsbad are willing to release all of said
ten per cent (10%) retention payment saving and excepting the sum of $5,000. OC
and
WHEREAS, R. L. Thibodo Construction Co., Inc., has submitted to the
City of Carlsbad a First Supplement to Agreement between Vista Sanitation
District and the City of Carlsbad and R. L. Thibodo Construction Co., Inc., a
copy of which is attached to this Resolution as Exhibit "A", and made a part
hereof by reference as fully as though set forth at length; and
WHEREAS, the Attorney for the City of Carlsbad has approved said Firs
Supplement as to form, and the City Council of the City of Carlsbad being fully
advised in the premises;
NOW, THEREFORE, on motion of Councilman Guevara , and
seconded by Councilman Atkinson 2
IT IS HEREBY RESOLVED AND ORDERED that the First Supplement

ment to the Secretary of the Vista Sanitation District, a copy of said Supplemenl
to be retained by the City Clerk of the City of Carlsbad to be filed with the

to Agreement between Vista Sanitation District and the City of Carlsbad and I R. L. Thibodo Construction Co., Inc., being Exhibit "A" attached hereto, be l and the same is hereby accepted and approved; that the Mayor of the City of
Carlsbad is hereby authorized to execute said First Supplement for and on
behalf of the City of Carlsbad; and upon acceptance by the City of Carlsbad,
said City Clerk of the City of Carlsbad is directed to return said First Supple-
records of said city.
IT IS FURTHER RESOLVED AND ORDERED, that the County Auditor
of the County of San Diego be directed to issue a County Warrant in the amount
of $48,230. 95 payable to R. L. Thibodo Construction Co., Inc., said sum
being equal to the ten per cent (1Oydretention paym'ent less the sum of $5,000. (
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Carlsbad at a regular meeting held on the 3rd day of June, 1964, by the
following vote, to wit:
AYES: Councilmen Atkinson, Guevara, Neiswender, Jardine and Hughes.
NOES: None
ABSENT: None
