(Assessment District No. 2-1962) WHEREAS, on the 5th day of Januarys 1965, the Engineer of Work led with the City Clerk of the City of Carlsbad hjs assessment to present the cost and expense of the work and improvement for the rk done upon those streets and properties in the City of Carlsbad, dered by Resolution No. 967 of the City of Carlsbad, and as said rk and improvement was done by Sim J. Harris Co., said work being re particularly described in Resolution of Intention No. 957; and WHEREAS, the City Clerk of the City of Carlsbad has duly given Itice of publication, posting, and mailing in the time and manner Iovided by law of the filing of said assessment and of the time of !aring thereon; and WHEREAS, the City Council of the City of Carlsbad has taken saic isessment under consideration and has received all oral and documen- try evidence, and any and all protests, .oceedings heretofore had, and the proper completion of the work and nprovement for which the assessment has been issued. lating to the assessm2nt3 NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of th ity of Carlsbad that a17 protests, if any, as the same appear upon qe minutes of the City Council of the City of Carlsbad at the date 2t for hearing, be, and they are hereby overruled. BE IT FURTHER RESOLVED that all proceedings prior -to the date o earing, relating to said assessment, and all acts and determinations f all officers and employees of the City of Carlsbad, in relation tc aid assessment, be, and the same are hereby ratified and confirmed. he City Council of the City of Carlsbad. BE IT FURTHER RESOLVED that the Engineer of Work is hereby ordered to deliver said warrant, assessment and diagram to Sim J. Harris CS., the Contractor, forthwith upon the payment by him of the balance of the incidental expenses due thereon, and the warrant shall bear the date of this order. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting of the City Council held on the 2nd day of February, 1965, by the following vote, to wit: AYES : Councilmen Atkinson, Jardine, Neiswender, Dunne and Hughes.
