HomeMy WebLinkAbout1965-03-02; City Council; Resolution 11101 i 2 4 C e 5 € 5 IC 39 3.2 1: 14 1: lt 1: It I< 2( 2: 2: 2: 24 21 21 2' 2 2 3 3 3 RESOLUTION NO. 1110 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN STREET IMPROVEMENTS AND APPURTENANCES AND APPURTENANT WORK IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OF ORDINARY PUBLIC BENEFIT: DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO BE ASSESSED TO PAY THE COST AND EXPENSE THEREOF: DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT ASSESSMENTS TO BE LEVIED; AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO SAID WORK OR THE EXTENT OF THE DISTRICT YO BE ASSESSED3 OR BOTH, AND GIVING NOTICE THEREOF. (Proposed Assessment District No. 1-1 965) The City Council of the City of Carlsbad, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That the public interest and convenience require and that it is the intention of the City Council of said City of Carlsbad to order the following work to be done or improvements to be made in the said City of Carlsbad, to wit: The construction of certain street improvements and appurtenan es, and appurtenant work in that portion of Chinquapin Avenue in said City, from its intersection with Garfield Street to its inter- section easterly with the Atchison, Topeka and Santa Fe Railroad Company right-of-way, be cleared, grubbed and graded; that the sub- grade be prepared and paved with two (2) inches of asphaltic concre surface course with chip seal coat laid upon four (4) inches of compacted and primed base material; Portland Cement concrete curb and gutter, sidewalks , depressed curb sectionsg driveway approaches and sidewalk underdrain, drainage channel paved with two (2) inches of asphaltic concrete surface course; four (4) inch cast iron under drain be constructed therein; six (6) inch and eight (8) inch extra strength vi tri fied cl ay pipe sewer main, standard precast manholes sewer appurtenances and appurtenant work; four (4) inch vitrified clay pipe sewer laterals be constructed therein; that portion of c* .. 3, 2 E 4 5 6 7 8 9 10 11 12 13 14 15 3.6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 Garfield Street in said City, from its intersection with Ch nquapin Avenue, 37.00 feet northerly and 37.00 feet southerly, be c eared, grubbed and graded; that the subgrade be prepared and paved with two (2) inches of asphaltic concrete surface course with chip seal coat laid upon four (4) inches of compacted and primed base materia Portland Cement concrete curb and gutter, sidewalks to be construct, ed therein; that the said work hereinbefore described shall be done to the official grades shown with the'exact nature, extent and location of said improvement to be in accordance with detailed plan on file with the City Clerk of the City of Carlsbad, containing fou sheets enti tl ed "Construction P1 ans for the Improvement of Chi nquap Avenue, from Garfield Street to the Atchison, Topeka and Santa Fe Railroad right-of-way, Project 5-2, Drawing No. 146-6" The estimated cost of said work or improvement, inclusive of incidental expenses, is the sum of $22,550.00. Section 2. That all the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points of the dimensions at the places and in the manner shown on the plan (which include profiles and detailed drawings) for said work, des- ignated "Construction Plans for the Improvement of Chinquapin Avenue, from Garfield Street to the Atchison, Topeka and Santa Fe Railroad right-of-way, Project 5-2, Drawing No. 146-6", consisting of four sheets, and in accordance with said plans and with the specifications for said work, which are designated "Contract Docu- ments and construction Specifications for Improvement of Chinquapin Avenue, from Garfield Street to the Atchison, Topeka and Santa Fe Railroad Right-of-Way, Assessment District No. 1-1965", Said plans and specifications were heretofore approved by this City Counci 1, and are on file in the office of the City Clerk of said City in the City Hall in said city, and reference is hereby made to said plans and specifications for the full and detailed description of said proposed work and for a description of the grades at which said -2- 0 Section 3. That in the opinion of this City Council the said contemplated work is of more than local or ordinary public benefit and this City Council hereby makes the expense of said work charge- able upon a district, which district this City Council hereby dec1ar.s to be the district benefited by said work and to be assessed to pay the cost and expense thereof. reference is hereby made to a plat or map of said district hereto- fore approved by this City Council, on file in said office of the City Clerk and designated "Assessment District No. 1-1965 Plat", which map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. For a description of said district Section 4. That serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assess- ment of fifty dollars ($50.00) or over remaining unpaid for thirty (30) days after the date or recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September.15th follow- ing their date. provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California, and pursuant to the provisions of Section 6464 of said Division 7 of this City Council hereby elects and determines that the redemption provisions of said bonds shall provide for a premium of five percent (5%) of the un- paid principal of said bonds to be paid as provided in said Section 6464 and in said Division 7 Said bonds are to be issued pursuant to and as Section 5. That the said proposed work is to be done under and proceedings therefor are to be under and pursuant to the said Improvement Act of 1917. 0 -3- I 1 2 3 when, and the Council Chambers of this City Council in the City Hall’ in said City of Carlsbad is the place whereg any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the proposed grades, may appear before the City Council of said city and show cause why said proposed work should not be carried out in accordance with this resolution of intention. and must be delivered to the said City Clerk not later than the hour herein set for hearing protests or objections. Protests or objections must be in writing All protests and objections must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same and shall be delivered to and filed with the City Clerk, City of Carlsbad at 2960 Pi0 Pic0 1 Drive, Carlsbad, California. 15 3.6 17 18 19 20 21 assessed by the State under Section 14 of Article XI11 of the Consti- tution at the address thereof shown on the last board roll trans- mitted to the County Auditor. Section 7. The CARLSBAD JOURNAL, a newspaper of general circu- lation published and circulated in the said City of Carlsbad and in the County of San Diego, California, is hereby selected as the newspaper in which this resolution of intention shall be made. said City Clerk is hereby directed to certify to the adoption of this resolution and to cause said resolution to be published in the The 1 manner provided by law. Section 8. The said City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Im- provement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said works whose names and addresses appear on the last equalized assessment roll or as known to the said City Clerk, in- 1 said assessment district notices of the passage of this resolution of intention in the time, form and manner provided by law.
