HomeMy WebLinkAbout1965-03-02; City Council; Resolution 1113r. 4- 3 i 2 4 L CI 6 7 8 9 40 11 12 33 14 15 16 3.7 18 19 20 21 22 23 24 25 26 27 28 29 3c 33, 32 0 0 RESOLUTION NO. 1113 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING FINDING THAT OWNERS OF NORE THAN 60% IN AREA OF THE PROPERTY SUBJECT TO ASSESSMENT IN HAVE SIGNED PETITION FOR IMPROVEMENTS; FINDING THAT THE PETITION FOR PROPOSED FILED WITH THE CLERK OF THE CITY OF CARLSBAD; AND FINDING THAT SAID PZYITION CEEDINGS REQUIRED BY DIVISION 4 OF THE STREETS AND HIGHWAY CODE OF THE STATE OF CAL I FORN I A. (Proposed Assessment District No. 2-1965) PROPOSED ASSESSMENT DISTRICT NO. 2-1 965 ASSESSMENT DISTRICT NO. 2-1965 HAS BEEN CONTAINS A WAIVER OF INVESTIGATION PRO- WHEREAS, on February 1, 1965, a’petition was filed with the 1 City Clerk of the City of Carlsbad, said petition bearing the date of December 30, 1964, wherein the petitioners requested the improve ment of Jefferson Street from Elm Avenue to Highway 101 Freeway; Home Street from Jefferson Street to Hope Avenue; Hope Avenue from Home Street to Grand Avenue; Grand Avenue from Jefferson Street to Hope Avenue; and Laguna Drive from Jefferson Street to Davis Avenue to construct concrete sidewalks, combination concrete curb and gutter; concrete cross gutters , drainage structures and conduits , asphaltic concrete pavement with base and sea1 coat, sewer service laterals as needed; and concrete driveway approaches and other appurtenant work for permanent street improvement; and WHEREAS, the City Engineer of the City of Carlsbad has filed with the City Council his report stating that owners of more than 60% in area of the property subject to assessment for such proposed improvement have signed said petition; and WHEREAS, it appears from the face of said petition that the signers thereof have waived the investigation proceedings required by Division 4 of the Streets and Highway Code of the State of Cal i forni a. NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve and find as follows: 1. That said petition has been filed with the Clerk of the 0 e City of Carlsbad on the 1st day of February, 1965. I 2. That said petition bears the signatures of the owners of more than 60% in area of the property subject to assessment for said proposed improvement. 3. That said petition waives investigation proceedings as required by Division 4 of the Streets and Highway Code of the State of Cal i forni a. BE IT FURTHER RESOLVED by the City Council of the City of Carlsbad that said petition is hereby accepted. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 2nd day of March, 7965, by the following vote, to wit: AYES : Councilmen Atkinson, Dunne, Neiswender and Jardine.
