HomeMy WebLinkAbout1965-03-16; City Council; Resolution 1112YI 8 9 I City of Carlsbad adopted Resolution No. 384, which denied a request for reclassification on property known as "South Carlsbad Annexation #I 1 25 26 27 5 c Planning Commission in denying the zone reclassification is hereby overruled and the appeal is allowed, granting zone reclassification from R-1 to C-M and I'M", pursuant to application on property known e RESOLUTION NO. 1112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, GRANTING THE APPEAL FOR RECLASSIFICATION ON PROPERTY DESCRIBED AS "SOUTH CARLSBAD ANNEXATION NO. 1.5", IN THE CITY OF AND I'M". CARLSBAD, FROM ZONE R-1 TO ZONE 6-b! WHEREAS, on January 12, 1965, the Planning Commission of the If No. 1.5" applied for by LAWSON MARTINEAU, ET AL; and WHEREAS, on January 15, 1965 Lawson Martineau, et al, appealed to the City Council to review the action of the Planning Commission; and NHEREAS, on the 2nd day of February, 1965, the City Council of the City of Carlsbad, at a duly advertised hearing, considered 16 11 said appeal ; and 3.7 18 WHEREAS, the City Council pursuant to Section 19.10 of Ordinance No. 9060 referred its findings to the Planning Commission 19 and requested a further report from them on the matter; and // 2o II WHEREAS, the Planning Commission's report on the matter was I 2111 received back by the City Council and considered, and the City 22 23 Council having considered all evidence submitted and all persons desiring to be heard, and good cause appearing therefor; 24 II NOW, THEREFORE, BE IT RESOLVED that the action of the 28 29 as "South Carlsbad Annexation No. 1.5". The following facts and reference make the approval of this amendment necessary to carry general purpose of Ordinance No. 9060: d 0 1. The present uses of the subject property is the best use at the present time, and the requested rezoning is necessa in order to allow continuance of said uses. 2. Any different zoning which may be considered in the future will have to base its justification therefore on changed 3. Public necessity, convenience and general welfare ezoning be granted. PASSED, APPROVED AND ADOPTED by the City Council of the r meeting held March 16, 1965, by the AYES: NOES: None ABSENT: Councilman Hughes.
