LILL be, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, RESCINDING RESOLUTION NO. 1002 OF THE CITY OF CARLSBAD, AND APPOINTING ENGINEER AND FIXING COMPENSATION. (Proposed Assessment District No. 2-1964) provided for the office of Engineer of Work and Superintendent of Streets in the "Improvement Act of 1911" in connection with the improvement work in the City of Carlsbad, and to be known as the improvement of Terramar Sewer District. BE IT FURTHER RESOLVED that said Wayne P. Lill shall act as Engineer of Work and Superintendent of Streets and is hereby employ- ed and appointed to furnish all surveys, original drawings, maps and blue prints, including any and all such maps necessary and incident 2o 21 22 23 24 911 and he is hereby appointed Engineer of Work for the proposed doing involved; all plans and specifications, all inspection work, pre- paration of assessment rolls, assessment diagram and warrant and any and all other services which shall be required from the Engineer of Work and/or Superintendent of Streets under the provisions of the IiImp ovement Act of 1911"; and lo// of all necessary engineering work and exercising all of the functionp z6 27 28 1 appointed as the person to supervise, inspect, and accept in behalf of the City of Carlsbad the installations, construction, performance and completion of such work and improvements. 19// to the rights of way contemplated in the improvement work herein 25 11 BE IT FURTHER RESOLVED that said Wayne P. Lill, acting in his capacity as Engineer of Work and Superintendent of Streets, shall receive as and for his compensatil for the services so specified, and as provided by law, the followii compensation, which shall consist of the following sums of money: (a) Eight percent (8%) of the contract price for engineerin! services. (b) Two percent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant. BE IT FURTHER RESOLVED that of the compensation so allowed tc s 'provided by law, shall be payable to the General Fund of the City of Carlsbad. BE IT FURTHER RESOLVED that said sum shall be based upon the contract price without incidentals, and in the event the proposed proceedings herein contemplated shall be defeated or for any reason fail of consummation, the said Wayne P. Lill shall be paid a reason able compensation for his services which he has performed, and whic in no event shall be less than $100.00. BE IT FURTHER RESOLVED that the fees herein provided to be paid to the said Engineer shall be payable as follows: (a) (b) Three-fourths (3/4ths) of the Engineering fee upon awarding and signing of contract for the work. The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the assessment and delivery of the warrant. PASSED, APPROVED AND ADOPTED at a regular meeting of the City :ouncil held on the 16th day of March, 1965, by the following vote, to wit: AY E,S : Councilmen Atkinson, Dunne, Neiswender and Jardine.
