HomeMy WebLinkAbout1965-04-06; City Council; Resolution 11281 RESOLUTION NO. 1128 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA3 DECLARING ITS INTENTION CLARING THE MORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT; DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO BE ASSESSED TO PAY THE COST AND EXPENSE THEREOF; DETERMINING MENTS TO BE LEVIED; AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO SAID WORK OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH, AND GIVING NOTICE THEREOF. TO ORDER CERTAIN STREET IMPROVEMENTS AND APPUR- TENANCES AND APPURTENANT WORK IN SAID CITY; DE- THAT BONDS SHALL BE ISSUED TO REPRESENT ASSESS- (Assessment District No. 1-1964) The City Council of the City of Carlsbad, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. That the public interest and convenience requir and that it is the intention of the City Council of said City of Zarlsbad to order the following work to be done or improvements to )e made in the said City of Carlsbad, to wit: The construction of concrete combination curb and gutter, drainage structures and appurtenances thereof pavement with stone chip seal and select sub-base, if neededs 4' concrete sidewalks, 8" sanitary sewer main with 4'' sewer service laterals and appurtenances thereof, 6'! water main including fire hydrants and 1" copper services with appurtenances thereof resetting of fences as needed, in Stratford Lane in its entirety. The estimated cost of said work or improvement, inclusive 2" asphaltic concretc and the of incidental expenses, is the sum of $40,474.00. SECTION 2. That all the aforesaid work or improvements sha be constructed at the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plansg (which include profiles and detailed drawings) for said work, designated "Construction Plans for the improvement of Stratford Lane in its entirety, Project No. 3-44, Drawing No, 141-2", consist-. ing of three sheets numbered 1 thru 3, and in accordance with said ilans and with the specificat iated "Contract Documents and ons for said work, which are desig- specifications No. 1-1964". Said plan 3nd specifications were heretofore approved by this City Council, ar 3re on file in the office of the City Clerk of said City in the City Hall in said City, and reference is hereby made to said plans and specifications for the full and detailed description of said proposed work and for a description of the grades at which said work is to be done. SECTION 3. That public right-of-way for street dedication on Stratford Lane is necessary in connection with the improvement and that the cost of the acquisition, including incidental expenses thereof be assessed as a part of the cost of such improvement; that said acquisition is more particularly shown on the plans, profiles, drawings, typical cross-sections and specifications contained in Right-of-way Map for Assessment District No. 1-1964, on file in the office of the City Engineering Department of said City; that the cost of such acquisition be advanced by the City of Carlsbad and that the City of Carlsbad shall thereafter be reimbursed from said assessment as a part of the incidental expense of said improvements SECTION 4. That in the opinion of this City Council the said contemplated work is of more than local or ordinary public ben and this City Council hereby makes the expense of said work charge- able upon a district, which district this City Council hereby declares to be the district benefited by said work and to be assess ed to pay the cost and expense thereof. district reference is hereby made to a plat or map of said districl heretofore approved and adopted by this City Council, on file in said office of the said City Clerk and designated "Plat of Assess- ment District No. 1-1964*'3 which map or plat indicates by a boundai line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. That notice is hereby given that the 4th day of May, 1965, at the hour of 7:30 P.M. is the day and hour when and II 2( the Council Chambers of this City Council in the City Hall in said 2: 2: 2: 21 2 2 2 2 2 2 5 . 8 1 City of Carlsbad is the place where, any and all persons having an: protest or objection to said proposed work or to the extent of sai assessment district, or to the proposed grades, may appear before the City Council of said City and show cause why said proposed wor should not be carried out in accordance with this resolution of in tention. Protests or objections must be in writing and must be de livered to the said City Clerk not later than the hour herein set for hearing protests or objections. SECTION 8.
