I ! 3.4 I: 3: 3: 1.c If at 3.7 PE 19 20 21 22 23 24 25 26 27 28 29 so 31 RESOLUTION NO. 1129 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING FINDING THAT OWNERS OF MORE THAN 60% IN AREA OF THE PROPERTY SUBJECT TO ASSESSMENT IN PROPOSED ASSESSMENT FOR IMPROVEMENTS; FINDING THAT THE PETITION FOR PROPOSED ASSESSNENT DISTRICT OF THE CITY OF CARLSBAD; AND FINDING THAT VESTIGATION PROCEEDINGS REQUIRED BY DIVISION 4 OF THE STREETS AND HIGHWAY CODE OF THE STATE OF CALIFORNIA. DISTRICT NO. 3-1965 HAVE SIGNED PETITION NO. 3-7965 HAS BEEN FILED WITH THE CLERK SAID PETITION CONTAINS A WAIVER OF IN- (Proposed Assessment District No. 3-1965) WHEREAS, on the 18th day of March, 1965, a petition was filed with the City Clerk of the City of Carlsbad, said petition bearing the date of December 23, 1964, wherein the petitioners re- quested the improvement of Acacia Avenue from Garfield Street to the Atchison, Topeka and Santa Fe Railway Company right-of-way to construct concrete sidewalks, combination concrete curb and gutter, asphaltic concrete pavement on adequate base with seal coat, sewer service laterals as needed, concrete driveway approaches drainage structures and conduits and other appurtenant work for permanent street improvement; and WHEREAS, the City Engineer of the City of Carlsbad has file with the City Council his report stating that owners of more than 60% in area of the property subject to assessment for such proposed improvement have signed said petition; and WHEREAS, it appears from the face of said petition that the signers thereof have waived the investigation proceedings required by Division 4 of the Streets and Highway Code of the State of California. NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve and find as follows: 1. That said petition has been filed with the Clerk of the City of Carlsbad on the 18th day of March, 1965.
