is hereby appointed to act in the name, place and stead of the "Superintendent
of Streets", as such name and title appears under the provisions of the improve-
ment Act of 1911".

A. RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD APPOINTING PERSON TO ACT AS ENGINEER OF WORK, DESIGNATING ENGINEER OF WORK AS THE
PERSON RESPONSIBLE FOR PREPARATION
OF THE ENGINEERING DOCUMENTS, ASSESS- MEXT DLAGRCIMS, ASSESSMENT ROLL AND WARRANT: DESIGNATING THE ENGINEER OF WORK TO SUPERTEE ALL WORK: APPOINT-
ING ENGINEER OF WORK AS THE SUPERIN- TENDENT OF STREETS AND FIXING COMPEN-
SATION FOR SERVICES.
(Proposed Assessment District No. 3-1965)
RESOLVED by the City Council of the City of Carlsbad that WAYNE P,
LL be, and he is hereby appointed Engineer of Work for the proposed doing
all necessary engineering work and exercising all of the functions provided
r the office of Engineer of Work and Superintendent of Streets in the Improve-
.ent Act of 1911" in connection with the improvement work in the City of Carls-
rd, and to be known as the improvement of Acacia Avenue, from Garfield
;reet to the Atchison, Topeka and Santa Fe Railway Company Right-of-way
BE IT FURTHER RESOLVED that said WAYNE P. LILL shall act as
ggineeer of Work and Superintendent of Streets and is hereby employed and
ppointed to furnish all surveys, original drawings, maps and blue prints,
icluding any and all such maps necessary and incident to the rights of way
ontemplated in the improvement work herein involved; all plans and specifica-
ions, all inspection work, preparation of assessment rolls, assessment dia-
:ram and warrant and any and all other services which shall be required from
he Engineer of Work and/or Superintendent of Streets under the provisions of
he "Improvement Act of 19 11 'I; and

BE IT FURTHER RESOLVED that said Wayne P. Lill is hereby appointed
is the person to supervise, inspect, and accept in behalf of the City of Carlsbad
;he installation, construction, performance and completion of such work and
improvements.

BE IT FURTHER RESOLVED that for such services that the said WAYNE
P, LLL, acting in his capacity as Engineer of Work and Superintendent of
Streets, shall receive as and for his compemsation for the services so specifiec
and as provided by law, the following compensation, which shall consist of the
€allowing sums of money:
(a) Eight percent (8%) of the contract price for engineering services.
(b) Two percent (2%) of the contract price for preparation of Assessment,
BE IT FURTHER RESOLVED that of the compensation so allowed to said
Zayne P. Lill as provided by law, shall be payable to the General Fund of the
2ity of Carlsbad.
Assessment Roll, Assessment Diagrams, and Warrants.
BE IT FURTHER RESOLVED that said sum shall be based upon the contract
>rice without incidnetals, and in the event the proposed proceedings herein con-
emplated shall be defeated or for any reason fail of consummation, the said
Vayne P. Lill shall be paid a reasonable compensation for his services which he
ias performed, and which in no event shall be less than $100.00.
BE IT FURTHER RESOLVED that the fees herein provided to be paid to the
:aid Engineer shall be payable as follows:
(a) Three-fourths (3/4ths) of the Engineering fee upon awarding and signing
(b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the assessment and delivery of the warrant.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlz
)ad at a regular meeting held on the 6th day of April, 1965, by the following vote,
