A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD AUTHORIZING AND DIRECTING CONDEMNATION OF EASEMENT FOR PUBLIC STREET AND IRI’GHT OF ’NAY PURPOSES.’ ‘

BE IT RESOLVED by the City of Carlsbad, California, a municipz
corporation, hereinafter referred to as CITY, by its City Council,
as follows:
1. That CITY hereby finds and determines as follows:
a. That there are located in the City of Carlsbad, Count)
of San Diego, State of California, certain parcels of
real property, hereinafter described as PARCELS A
and 3, and particularly described on the attachments
hereto, marked PARCELS A and 8, which attachments are
by this reference incorporated herein.
b. That the public interest and necessity require the
acquisition by CITY of easements for public street
and right of way purposes in said PARCELS A and B.
c, That the public interest and necessity require the
construction and completion in said PARCELS A and B,
by CITY, of a public street and right of way.
d. That the taking of said easements for public street
and right of way purposes in said PARCELS A and 3
is necessary for said acquisition, construction, and
completion.
e. That said use to which said easements in said PARCELS
A and B are to be applied is a use authorized by law,
2. That the City Attorney of CITY is hereby authorized and
directed on behalf of CITY to acquire said easements in said
PARCELS A and B for public street and right of way purposes under
the laws of eminent domain of the State of California,

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 3rd day of August, 1965, by the
following vote, to wit:
AYES: Mayor W. C. Atkinson, Jr, and Councilmen Dunn,
Neiswender, Hughes and Jardine.
NOES:, None
ABSENT: None
