A RESOLUTION OF THE CITY COUNCIL QF THE CITY OF CARLSBAD OVERRULING ALL
ING THE ASSESSMENT AND CONFIRMHEG THE REGULARITY OF PROCEEDIMGS.
(Assessment District No. 1-1965)
PROTESTS OM TlYE ASSESSMENT, CONFIRM-
1 WHEREAS, on the 5th day of October, 1965, the Engineer of Work
filed with the City Clerk of the City of Carlsbad his assessment to
represent the cost and expense of the ~~rk and improvement for the
work done upon those streets and properties in the City of Car’Bsbad,
ordered by Resolution No. 1133 of the City of Carlsbad, and as said

1111 work and improvement was done by Asphalt Service, said work being I j
I I hearing thereon; and
WHEREAS, the City Council of the City of Carlsbad has taken sai
assessment under consideration and has received all oral and documen
tary evidence, and any and all protests, relating to the assessment,]
; 121/ more particularly described in Resolution of Intention No. 1170; andi

City of Carlsbad that all protests, if anys as the same appear upon
the minutes of the Cjty Council of the City of Carlsbad at the date 1 I
set for hearing, be, and they are hereby overruled. I

BE IT FURTHER RESOLVED that all proceedings prior to the date I
of hearing, relating to said assessment, and all acts and determina-1
t-ions of all officers and employees of the City of Carlsbad, in
relation to said assessment, be, and the same are hereby ratified
and confirmed. i
BE IT FURTHER RESOLVED that saa’d assessment and the diagram
and warrant attached thereto, be, and the same is hereby confirmed
WHEREAS, the City Clerk of the City of Carlsbad has duly given ,
1411 notice of publication, posting, and mailing in the time and manner
1511 prova’ded by law of the filing of said assessment and of the ti:?e of I 1
I 2oii proceedings heretofore had, and the proper completion of the work I / I 21/1 and improvement for which the assessment has been issued.

by the City Council of the City of Carlsbad.
BE IT FURTHER RESOLVED that the Engineer of Work is hereby
ordered to deliver said warrant, assessment and diagram to Asphalt
Services, the Contractor, forthwith upon the payment by him of
the balance of the incidental expenses due thereon, and the warrant
shall bear the date of this order.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting of the City Council held on the
16th day of November, 1965, by the following vote, to wit:
AYES: Councilmen Dunne, Neiswender, Atkinson and Jardine
NOES: None
ABSENT: Councilman Hughes
