MAKING FINDINGS AND OVERRULING PRO- (Assessment District No. 3-1965) WHEREAS, this City Council by its Resolution No. 1219 adopted on the 1st day of February, 1966, declared its intention to order the construction of certain street improvements and appurtenances and appurtenant work under the Improvement Act of 1911, Division 7 of the Streets and Highways Code, and in said resolution fixed the 1st day of March, 1966, at the hour of 7:30 P.N., in the Council Chambers of this City Council, as the time and place for the hearing before this I City Council of protests and objections; and I WHEREAS, at the time and place fixed in said Resolution No. 1219 I j I a hearing was duly held by this City Council for hearing all written protests or objections; that the Clerk filed her certification with the City Coucnil that no written protests had been filed; that the Clerk gave all persons present an opportunity to be heard in respect I of any matter relating to the work proposed in said Resolution No. 1219 or the boundaries of the assessment district described therein, or in any way related to the proceedings proposed by said Resolution NO. 1219; and I 1 I WHEREAS, all persons desiring to appear and be heard have been I heard:, and this City Council has taken evidence relating to said pro- I posed works the boundaries of the proposed assessment district and 1 the benefits to the property to be included in the proposed assess- ment district, and is fully informed in the premises; il 28 29 NOM, THEREFORE, the City Council of the City of Carlsbad, Cali- fornia, DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: 0 1 2 3 4 5 6 7 8 9 10 11 12 I I 0 I' Section 2. The City Council finds and determines that no pro- tests or objections have been made. Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of the assessment district are defined and estab- lished as the boundaries described in the resolution of intention, f 1 to wit: Resolution No. 1219, and the work proposed to be done is soluta'on No. 1219, and reference is hereby made to said Resolution 1 I I likewise defined and esrablished as the work described in said Re- I No. 12'89 for a full and complete description of said work and of the assessment district and for further particulars. i 1 Section 4.
