MAKING FINDINGS AND OVERRULING PRO- (Assessment District No. 5-1964) WHEREAS, this City Council by its Resolution No. 1221 adopted on the 15th day of February, 1966, declared its intention to order the construction of certain street improvements and appurtenances and appurtenant work under the Improvement Act of 1911, Division 7 of the Streets and Highways Code, and a’n said resolution fixed the 115th day of March, 1966, at the hour of 7:30 P.fUl.9 in the Council Chambers of this City Council, as the time and place for the hear- ing before this City Council, of protests and objections; and WHEREAS, at the time and place fixed in said Resolution No. 1221 a hearing was duly held by this City Council for hearing all cvritten protests or objections; that the Clerk filed her certification with the City Council that no written protests had been filed; that the Clerk gave all persons present an opportunity to be heard in respect 3f any matter relating to the work proposed in said Resolution 80. 1221 or the boundaries of the assessment district described therein, 3r in any way related to the proceedings proposed by said Resolution lo. 1221; and NHEREAS, all persons desiring to appear and be heard have been ieard, and this City Council has taken evidence relating to said aroposed work, the bowndarfes of the proposed assessment da’strict 2nd the benefits to the property to be included in the proposed asse. lent district, and is fully informed in the premises; NOW,THEREFBRE, the City Council of the City of Carlsbad, Cali- ‘ornia, DOES HEREBY FIND, RESOLVE, DETERNINE AND ORDER as follows: That protests or objections have not been made by Section 1. ;he owners of one-half of the area of the property to be assessed ‘or said proposed work. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 Section 2. The City Council finds and determines that no pro- tests or objections have been made. Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of the assessment district are defined and established as the boundaries described in the resolution of intent- ion, to wit: is likewise defined and established as the work described in said Resolution No. 1221, and reference is hereby made to said Resolution No. 1227 for a full and complete description of said work and of the assessment district and for further particulars. Resolution No. 1221, and the work proposed to be done Section 4. That this resolution shall be entered upon the minutes of th s City Council.
